November 17, 1976 PUBLIC NOTICE ORDINANCE 76-5 AN ORDINANCE A- MENDING ORDINANCE NO. 71-2 RELATING TO SANITATION AND THE PROMOTION OF PUBLIC HEALTH AND SAFETY BY PROVIDING FOR THE STORAGE, COLLECTION AND DISPOSAL OF ASH- ES, GARBAGE AND RE- FUSE IN THE BOROUGH OF MARIETTA, PENNSY- LVANIA; GIVING THE BOROUGH COUNCIL THE AUTHORITY TO SET BY RESOLUTION, THE SER- VICE CHARGES TO BE IMPOSED UPON OWNERS OF DWELLING UNITS IN SAID BOROUGH. BE IT ENACTED AND ORDAINED by the Bor- ough Council of the Bor- ough of Marietta, Lancaster County, Pennsylvania, and it is hereby enacted and ordained as follows: I. Ordinance 71-2 enact- ed April 28, 1971 is hereby amended by repealing Sec- tion 8 thereof and sub- stituting in its place the following new Section 8: SECTION 8— Service Charge. Beginning with the effective date of this Or- dinance, there is hereby levied, assessed and im- posed upon each dwelling unit in the Borough of Marietta for the collection and removal of ashes, gar- bage and refuse, such service charge as may, from time to time, be set by the Borough Council by resolution. The aforesaid service charge shall be levied, assessed and im- posed on a monthly basis, but billing for the aforesaid service charge shall be on a quarterly basis. Each a- partment shall be consider- ed as a separate dwelling unit. II. Ordinance 71-2 enact- ed April 28, 1971 is hereby amended by repealing Sec- tion 9 thereof and sub- stituting in its place the following new Section 9: SECTION 9— Billing. Beginning upon the effec- tive date of this Ordinance, the Borough Secretary of the Borough of Marietta is directed to bill each and every owner or owners of dwelling units in the Bor- ough of Marietta a service charge levied and assessed by this Ordinance as is from time to time estab- lished by the Borough Council in accordance with Section 8 of this Ordinance. Ordinance 69-7 enact- ed May 13, 1969, known as the Housing Ordinance of the Borough of Marietta, as amended, is hereby a- mended by adding a new Section as follows: SECTION 1.9.1.— The Housing Officer shall have the authority to institute summary criminal proceed- ings as a means of en- forcement of this Ordin- ance, and, shall when act- ing within the scope of his employment hereunder have the powers of a police officer of the Borough; provided, however, that under no circumstances shall he have the power of arrest. II. Ordinance 69-7 enact- ed May 13, 1969 known as the Housing Ordinance of the Borough of Marietta, as amended, to the extend that such is not amended by Section I of this Ordin- ance, shall be and is ratified and confirmed in all respects and shall re- main in full force and effect.
