The authorized debt of the Borough is hereby in- creased in an amount up to $2,780,000, consisting of Lease Rental Debt (as defined in the Local Government Unit Debt Act, No. 185 of 1972, which as amended is herein termed the “‘act’’), which, together with any other Lease Rental Debt and other debt of the Borough now existing, will not result in a violation of the limitations of PUBLIC NOTICE RESOLUTION OF EAST DONEGAL SEWER AUTHORITY WHEREAS, the Board of Supervisors of the Town- ship of East Donegal, Lancaster County, Pennsyl- vania on April 24, 1969 enacted an ordinance (Or- dinance NO. 5-1969) requir- ing owners of properties which have a principal building within 150 feet from the sewer system to connect to said system; and WHEREAS, the ordin- ance provides that the cost of connection shall be borne by the owner of the improved property; and WHEREAS, the ordiance further provides for the adoption of additional rules and regulations to imple- ment the ordinance so en- acted; and WHEREAS, the Author- ity by law may charge appropriate connection fees and tapping fees to owners of improved properties re- quired to connect to the system; NOW, THEREFORE, be it: 1. RESOLVED, that prior to obtaining a permit, in addition to all other re- quirements of the ordin- ance, an owner desiring to or required to connect to the sewer system shall have paid a fee, called a ‘‘connection fee,”’ in the amount of One Hundred Seventy-Five Dollars ($175). 2. RESOLVED, that the owner of any improved property desiring or re- quired to connect to the sewer system shall be re- sponsible for and shall pay a '‘tapping fee’’ consisting of the difference between the total actual cost of work required to complete con- nection of the improved property to the sewer system in compliance with the ordiance and the One Hundred Seventy-Five Dol- lar ($175) ‘‘connection fee’ advanced for a permit, it being the intention of this resolution that all charges to connect to the system shall be borne by the owner. 3. RESOLVED; that upon demand and failure of any such property owner to pay the ‘‘connection fee’’ and ‘tapping fee’’, the Author- ity shall enforce payment thereof by municipal lien filed against said property and its owner or reputed owner, or by any other process authorized by law. Said Lease Rental Debt is to be incurred by guaranteeing payment of the principal of and interest on the Authority's Guaranteed Water Revenue Bonds, Series of 1976, issued for the purpose of providing funds for and toward refunding all of the $485,000 aggregate principal amount of Authority’s Water Revenue Bonds, Series of 1954, and Water Revenue Bonds, Series of 1966, presently outstanding and for constructing and equipping improvements to the Authority's existing water system (such construction and equipping being herein called the '' Project”). 2. The maximum amount of Authority's Guaranteed Water Revenue Bonds, Series of 1976, to be secured by the Guaranty Agreement is $2,780,000. Such Bonds are to be issued under the Author- ity’s Trust Indenture dated as of December 1, 1976, which provides that such Bonds shall be secured by the pledge of revenues derived by the Authority from its water system and guaranteed by the Guaranty Agreement. 3. The above-mentioned debt to be incurred by the Borough shall be Lease Rental Debt. 4. The Guaranty Agreement is hereby approved in sub- stantially the form presented to this meeting, with such changes, if any, as may be approved by the officers of the Borough Council executing it, whose execution thereof shall be conclusive evidence of such approval. The President or any Vice President of the Borough Council is hereby authorized and directed to execute the Guaranty Agreement on behalf of the Borough with any above-mentioned changes, and the Secretary of the Borough Council is hereby authorized and directed to affix thereto and attest the seal of the Borough, and then to deliver the Guaranty Agreement on behalf of the Borough. S. The principal of and interest on the Authority's Guaranteed Water Revenue Bonds, Series of 1976, are to be payable from the revenues derived from the operation of the Authority's water system. The proper officers of the Borough are hereby authorized and em- powered to take all such further action and execute such additional documents as they may deem appropriate to carry out the purposes of this Ordinance. 8. The engineering report of Gannett Fleming Cotddry -and Carpenter, Inc., ‘the Author- ity's Consulting Engineers, given pursuant to Section 206 of the Act, with respect to the improvements to the water system to be constructed and equipped by the Authority is hereby approved. 9. This Ordinance shall become effective on the earli- est date permitted by the Act. 10. If any part of this Ordin- ance shall be held to be illegal or invalid, that shall not affect any other parts hereof, all of which ‘shall be construed as if the illegal or invalid part had not been included herein. 11. All ordinances and reso- lutions or parts thereof insofar as they are inconsistent here- with are hereby repealed or rescinded.
