not completely establislied before Johnson

TRIAL OF DAVIA —We leach from the
Baltimore Americas that there has been
considerable excitement at Richmond, Nor
folk and Portsmouth on account of the expec
ted visit of Jeff. Davis to the former city , in
a few days, to appear before the United States
Court, as there seems to be no doubt that
'President Johnson has ordered General Bur•
ton to deliver the prisoner to the United
States Marshal for the Eastern District of
Virginia. Unless Davis' counsel and friends
have some assurance that the Governmeat is
ready to proceed with the trial of the great
traitor, it is said they have made a great blun
der in obtaining the writ of habeas corpus, as
Judge Underwood will not release him on
hail,"but send him to the Virginia Peniten
tiary. A Richmond despatch of last night
announces the meeting of the United States
Court yesterday, and gives an ahstract of
Judge Underwood's charge. to the Grand Ju
ry, among the members of which are Ron-
John Minor Botts, Ron. Joseph Seger, ex-
Mayor McKenzie, of Alexandria,' and five
colored men. The Judge said that. the Court
had,been threatened with. assassination, but,
thanks to the legislation of 'Congress, it met
now in security'. Ile denounced the press of
Richmond as disloyal, and said it had, en
couraged perjury and countetfeiting to cheat
the government of the 'Golfed States. The
Examiner claims to • have information that
the session of the Court will be prolonged
until the adjournment of the Supreme Court,
when Chief
,Justice Chase, will preside, at
Davis' trial. The latter is expected in Rich,
cuond on Saturday.
