Sunday, August 22, 2010 THE DALLAS POST PAGE 5 HARVEYS LAKE BOROUGH Residents continue pressurring about boathouses By EILEEN GODIN Y Dallas Post Correspondent Decreasing the building size of lake front properties through zoning was suggested for con- sideration to the Harveys Lake Borough Council on Tuesday night at a special public hearing to discuss redefining boathouses in accordance with the bor- ough’s zoning ordinance. Last May, council approved a new zoning manual which de- fines boathouse as a “structure constructed either wholly or partially over a body of water to provide shelter for water craft or for marine-related equipment.” Under the current ordinance, kitchenettes and bathrooms are prohibited in a boathouse. Since this ordinance was ap- proved, residents have tried to have council reconsider and al- low bathrooms in boathouses. Residents had cited safety rea- sons saying otherwise children, family and guests would have to cross busy Lakeside Drive to re- turn home to have access to bathroom facilities. In his absence, the borough’s Planning Commission Attorney Mark McNealis submitted a let- ter indicating that the commis- sion will continue to “prohibit the establishment of any living quarters or structures other than docks and boathouses in the shoreline zoning district.” Last May, council approved a new zoning manual which defines boathouse as a “structure constructed either wholly or partially over a body of water to provide shelter for water craft or for marine-related equipment.” Under the current ordinance, kitche- nettes and bathrooms are prohibited in a boathouse. The Planning Commission al- so strongly recommends chang- es to property variances and side yard setbacks, the required space from a property line to where a structure can be built. McNealis said the commis- sion wants to change the re- quirement of building dock properties 25 to 50 feet wide to prevent overcrowding along the lake front area, a S-1 zoning dis- trict. Council noted these chang- es would create many non-con- forming lots within the borough. Council president Francis Kopko ended the public meeting so council members can discuss the issues before re-adjourning Luzerne County Fair entertainment announced The Luzerne County Fair will be held from Wednesday, Sept. 8, to Sunday, Sept. 12, at the fair- grounds, Route 118, Dallas. Hours are 4 to 11 p.m. on Wednesday and Thursday, 4 to 11:30 p.m. on Friday, 11 a.m. to 11:30 p.m. on Saturday and 11 m. to 9:30 p.m. on Sunday. Ad- ission to the fair is $8 for adults, $4 for senior citizens and free for children under 2 years of age. Free parking is located in lot “A” on the fair side or Route 118 with a free shuttle from parking lot “B” on the north side of the fairgrounds. Lakefront property owners Jay and Molly Crossin, Pole 9, said, if approved, the proposed ordinance would be detrimental for them. Molly Crossin said the couple had blueprints made be- fore last year’s changes to the boathouse ordinance. She said their plan was to build a boath- ouse within the required 30 feet. If the variances are changed, it would only allot them 20 feet of building space. After reconvening, council ta- bled its decision on the boath- ouse ordinance amendment for further discussion. Williams said the organization is a team of lawyers working on a voluntary basis that will write ordinances and defend them in court if necessary. He wants to have borough solicitor Charles McCormick review the informa- tion before proceeding with it. “We must meet with our solic- itor to make sure no loopholes are created and that we are fully protected,” Williams said. Mayor Clarence Hogan is ar- ranging for a gas drilling infor- mation night next week but the time and date were not yet avail- able.
