Lucas said Sheetz had no problem with the "fairly standard housekeep- ing items” the commission had pointed out. and wanted to know it the commission could condi- tionally approve the application. providing Sheetz promised to clean it up in time for the supervisors’ work sessionondan. 13. He did warn the commission that the required let- ters from such authorities as the Dallas Area Municipal Authority and Pennsylvania Department of Transportation (PennDOT) may take more time. as Sheetz had no control over those agencies. Planning commission member Michael Kolesar then made the motion to recommend the Sheetz subdivision application for ap- proval to the Board of Supervi- sors: Sean McAndrew seconded the motion. and it was passed unanimously. The mistake in des- ignation of the subdivision will be remedied. and the major subdivi- sion plans will now be submitted to the Board at its Dec. 13 meet- ing. The second item of business was toreview the preliminary land development application. Some of the problems included the lack of a highway occupancy permit from PennDOT (although it has been applied for); Sheetz has not yet shown compliance with the Toby's Creek Stormwater Ordinance: there must be an easement through the existing two proper- ties. Grange Bank and Verizon: the required wetlands report has not been done; and Sheetz must provide a proposed solution to the groundwater problem at the end of the property. Frank Grabowski, ‘Planning Commission Vice-Chief, informed the Sheetz representatives the township had a specific sign ordi- nance; Sheetz would have to ad- dress the zoning hearing board in regards to its sign. Price asked “about the lighting at the new loca- tion — had a footcandle reading been done? “It's unusual for them to do that — they wouldn't do that for us.” Russ Newell Newell Fuel and NewMart Mike LaCesa said it had not. but as in the case of the sign ordinance. Sheetz would be happy to follow the dictates of the town- ship. "We conform to the munici- pality in which we build the store .. were willing to work with vou folks on that.” he said. If the board of supervisors ap- proves the land development plans. site preparation work can begin — that is. the land can be cleared to ready it for develop- ment — but no construction or paving can be done until final approvalis given. Sheetz does not intend to begin construction until given the green light to do so. Russell and Sherri Newell. of Newell Fuel. have been circulat- ing petitions — "Opposed to Pro- posed Development of Sheetz Store” — in the community and in their NewMart on Memorial High- way: thus far they have gathered 240 signatures. Eric May. of Pen Fern Oil Co. has retained a law- ver. Attorney Tom Brennan. who got up during the portion of the meeting for audience comments and spoke on his client's behalf. Brennan said there were “sub- stantial issues” in regards to the Sheetz plan and a report was be- ing compiled; he had already sent a letter to the planning commis- sion. which had been received but not distributed. Solicitor Benjamin R. Jones III asked if there was any objection to the commission's decision to approve Sheetz's preliminary sub- division application. “I don't like to approve some- thing until I have what it is I'm supposed to approve,” Brennan replied. However, he said, “We want to be constructive and work with you.” After the meeting, the Newells appeared a little dazed at how quickly things had moved. "It’s unusual for them to do that — they wouldn't do that for us,” Russell Newell said of the commission's apparent willing- ness to overlook the 22 items in the Sheetz application. "That still doesn’t mean it can’t crumble on them,” he added. Kingston Township has an- nounced the Pennsylvania Ameri- can Water Company (PAWC) will soon complete the installation of new water mains on various streets in the Trucksville area. The water company will resur- face the streets in the spring of 2001. The permits issued by the Township. and by agreement with PAWC. require a full width over- lay of all streets where trenches were dug for the new water lines.
