Around 1975 we established an approved public notification DAMA system (which includes) a siren signal 20 minutes before a blast as well as an all clear signal after- ward. We are not required to advertise in the newspaper ahead of time.” After the vote was taken and the agenda was concluded, Ed Chesnovitch asked “If blasting is done in an agricultural area, is it time to enforce the blasting ordi- nance? Now you say cease and desist on all blasting?” Solicitor Evans responded “We'll be back in court with Judge Cappellini. We're already in court on the in- junction issue.” He assured Chesnovitch the judge cannot sit on the issue until it goes away. The state has said DAMA cannot stop servicing GMAHL without violating the Clean Streams Act and facing fines and other penal- ties from the DEP. The lawsuit and the appeal have the same goal: to get the state to acknowledge that DAMA'’s obliga- tion to GMAHL has ended and to force GMAHL to find alternate means to transport and process wastewater, as mandated by the Pennsylvania Sewage Facilities Act. “InDAMA’s opinion, GMAHL's alternate plan is flawed,” said Jones. The two municipal authorities are entering arbitration concern- ing the $608,542.83 that GMAHL still owes DAMA. DAMA is funded by user fees from Dallas Town- ship, Dallas Borough, Kingston Hurst Home Specialities Co. Both the appeal and the law- suit will take time to move through the legal system, and DAMA will have to sue GMAHL again to col- lect the monies owed for the ser- vice since January 1. “We just hope that it can be worked out. We've had a good relationship with DAMA, and I'd hate to see that disappear,” said Richard Boice, mayor of Harveys Lake and executive director of the Harveys Lake authority.
