DISTRICT COURT BRIEFS Sweet Valley man, 32, charged with sexual assault of children Robert Mowery, 32, of RR 1, Box 1151, Sweet Valley faces multiple counts of rape, involun- tary deviant sexual intercourse, aggravated indecent assault, in- decent assault and corruption of minors as the result of a state police investigation. Police said Mowery had repeat- edly assaulted a 10-year-old and 7-year-old boy during the sum- mer. The 10-year-old reported at least six incidents, and the 7- year-old at least 10. The older boy also told police that on once occa sion Mowery held a knife to his chest and threatened that if he told anyone Mowery would kill him. Trooper Thomas Appleman, of Berwick, began the investigation after he was called to Nesbitt Me- morial Hospital in August after one of the boys had been exam- ined by a doctor there. Interviews were conducted at the state police barracks in Shickshinny and at the offices of Luzerne County Children and Youth. The children said the assaults had taken place at Mowery’s house on Mooretown Rd. in Lake Twp. SEX OFFENDER FAILS TO TELL ADDRESS CHANGE Michael David Calia, 37, of 162 S. Main St., Pittston, is charged with failing to notify the Pennsyl- vania State Police when he moved from 19 Old Grandview Ave., Dal- las, this spring. Police said the Calia, a convicted sex offender, told state police March 31 that his address was 19 Old Grandview Ave., Dallas. When Dallas Twp. police officer Douglas Higgins spoke with the owner of the house on May 10, he was told Calia had moved our on April 5. Under “Megan's Law,” registered sex of- fenders must inform the state police of a new address within 10 days. BROTHERS CAUGHT CAMPING IN MAUSOLEUM Leonard R. Tarreto III, 23, and his brother, Ryan M. Tarreto, 20, both of 27 Idlewood Dr., Dallas, are charged with criminal tres- pass after being observed the evening of Aug. 20 sleeping inside a mausoleum at Chapel Lawn “Memorial Park. Dallas Twp. po- lice officer Brian Feeney and three other officers responded toa com- plaint that a tent and other camp- ing equipment was found in the park. When police arrived, the tent was not seen, but when Feeney shined a flashlight inside a mausoleum he saw the two men sleeping inside. The camping equipment was also inside the building. CHARGED WITH TAMPERING WITH CARS Fred L. Parry, 26, of 147 Wardan Ave., Trucksville, is charged with criminal mischief, theft, disorderly conduct and public drunkenness after he was arrested July 10 at the Nittany Apartments near Penn State Wilkes-Barre. Lehman Twp. police officer John Young was called to the scene at about 3:30 a.m. by two people who said they had seen someone trying to break into their cars. Young went around the side of the building and found Parry sitting alone. Parry said he was waiting for a ride. The two witnesses identified Parry as the KIDS ACT UP! DRUG POSSESSION CHARGED Steve Horvath will face county court trial on charges of posses- sion of marijuana and several motor vehicle counts. He was ar- rested the afternoon of July 16 by Dallas Borough police officer James Martin after Martin saw Horvath driving a yellow motor- cycle at a high rate of speed on Upper Demunds Rd. When he was stopped, Horvath said he did not have a license and the motorcycle did not belong to him. Martin found a small packet of mari- juana in Horvath'’s pocket during a pat down search. The motor- cycle had a Florida validation sticker dated 06/00 placed on the license plate, and Horvath’s li- cense was under suspension on a DUI related charge. DUI CHARGES * Donald Roger Thomas, 39, of 95 Claude St., Dallas, was ar- rested twice in the span ofa month. ‘Thomas was first arrested June 27 by Dallas Borough police of- ficer David Rinehimer after the policeman saw a car driven by Thomas speeding on Rt. 415 near the bowling alley. Rinehimer clocked the car at 66 mph in a 40 mph zone. After the car was stopped, Rinehimer saw that Tho- mas appeared to be intoxicated. Thomas failed field sobriety tests, and was taken to Wilkes-Barre General Hospital for a blood alco- hol test which measured .146 percent, over the .1 percent legal limit. Thomas is also charged with speeding in this incident. Rinehimer arrested Thomas again on July 25 following a report of a one-car accident on Machell Ave. A witness said he had seen a car hit a telephone pole, then back up and leave. Rinehimer found parts of the car at the scene, and went to Thomas's residence based on the description of the vehicle. The car was parked in front of 95 Claude St., with-damage that matched the description. When Thomas came out of the house, he failed field sobriety tests. Kocher, 23. of RR'1, Box 151 Noxen Rd., Harveys Lake, will face a DUI charge and a charge of careless driving after being ar- rested May 31 by Dallas Borough police officer James Martin. Mar- tin said that he saw a car driven by Kocher driving very slowly and weaving in an erratic manner at about 2:45 a.m. After the car was stopped, Kocher had great diffi- culty finding the registration and insurance cards, according to Martin's affidavit of probable cause. Kocher failed field sobriety tests, and his blood alcohol level was measured at .106 percent by chemical test. ¢ James V. Hannagan, 38, of 446 Hoyt St., Pringle, will face trial on charges of DUI, failing to keep right and careless driving. He was arrested May 22 after Harveys Lake police officer James Karlowicz was called to the scene of an accident on Rt. 415 in front of the police department. Hannagan told Karlowicz that he was driving north when another car hit him on the driver's side and helost control. Karlowicz said Hannagan appeared to be intoxi- cated, and part way through field sobriety tests said “I can’t do any more, I'm drunk.” Hannagan's blood alcohol level was measured at .145 percent. The following defendants waived their right to preliminary hearings before District Justice James Tupper. Their cases have been sent to county court: * Brian Mosier, 25, of RR 2, Box 282, Hunlock Creek, who was arrested July 26 by David Fitch of the Lehman Twp. police depart- ment. Fitch responded to an acci- dent June 26 on Rt. 29 between Moon Lake Rd. and Lake Silkworth. A car driven by Mosier had missed a curve, crossed the road and struck a tree. There were no skid marks, Fitch said. more than twice the legal Mosier was trapped in the car ari’ ) his injuries prevented Fitch from interviewing him, but blood alco- hol tests taken at Community Medical Center measured .132 percent. Mosier is also charged with careless driving and disre- garding a traffic lane. * Michael J. Dymond, 23, of RR 3, Box 238A, Dallas, who was arrested Aug. 12 by Dallas Twp. police officer Jeffrey Dennis, who saw a car driven by Dymond traf) eling at 62 mph in a 40 mph zone on Upper Demunds Rd. just after midnight. When Dennis followed the car, it went even faster and “was weaving and jerking and driving in the opposite lane,” Den- nis said in a affidavit of probable cause. Dymond failed field sobri- ety tests and his blood alcohol level measured .165 percent. \ is also charged with speeding an” failing to keep right. * Laura Bassolino, 35, of RR 1, Box 123-6, Harveys Lake, who was arrested June 3 by James Drury of the Dallas Borough Po- lice Dept. A call had been made to 911 reporting a car driving errati- cally on Rt. 309 in Shavertown. Drury saw the car following an- other at an unsafe distance, then pass a car on the right befor again following too closely. Whe) Drury turned on his lights and siren the car did not pull over at first, and only stopped after driv- ing past another police cruiser that was positioned in the facing lanes. Drury said Bassolino ap- peared intoxicated, and she failed field sobriety tests. A blood alco- hol test measured .199 percent, « Jacob Harris, 38, of 955 GateS) Rd., Shavertown, who was ar- rested June 26 by Benjamin Bigus of the Jackson Twp. Police Dept. Bigus was called to an accident on Follies Rd. in which a man was lying on the ground with a motor- cycle on top of him. Bigus could smell alcohol, and blood records from Geisinger hospital measured .17 percent.
