22 DISTRICT COURT BRIEFS The Dallas Post Dallas, PA Wednesday, April 22, 1998 Dallas man charged with stealing truck, driving drunk, resisting arrest George Sims Jr., 42, of Dallas, ‘was arrested March 17 by Dallas ‘Township patrolman Jeffrey J. Dennis after police observed Sims driving fast on Rt. 309 in a tank truck without headlights. “ Sims pulled the truck over for police, but rammed the back of a police car when it attempted to ‘pull in front of his stopped truck. He then pulled back and slammed into the passenger side of the police car causing it to lift from the ground. He tried again to hit the police car, but an officer gained entry into his truck and shut it off. Sims had an open can of Budweiser in his had. Sims hit and tried to push off police, the police report said. Af- ter being cuffed, he threatened to kill the arresting officers. He was ergo 5 = FEF IEP then taken to the Wilkes-Barre ‘General Hospital for a blood alco- hol test. The results were submit- ted for analysis. Sims was then taken back to the Dallas Township Police Sta- tion where he was read his Miranda rights and told police that he knew he was drunk and had been drinking all night. He told police that he stole the truck he was driving from Glen Bottle Co. in Larksville that same night. He said he drove without head- lights on because he did not want anyone to see him and admitted that he was trying to push the police car so he could get away. Sims was charged with driving under the influence of alcohol, recklessly endangering another person, terroristic threats, crimi- nal mischief, resisting arrest, dis- orderly conduct, fleeing or at- tempting to elude officers, restric- tion on alcoholic beverages, reck- less driving, driving without head- lights to avoid arrest, driving at an unsafe speed, disregarding a traffic lane and lacking the re- quirement for commercial driver’s license. Related charges of simple as- sault, aggravated assault and re- ceiving stolen property were dis- missed. D.U.L CHARGES * Tunkhannock resident Micah A. Price, 24, was arrested Jan. 15 by Dallas Borough patrolman James Martin after police ob- served him driving erratically on Rt. 309 and Rt. 415. After failing field sobriety tests, he was taken to Wilkes-Barre Gen- eral Hospital where his blood al- cohol level was determined to be «189. He was charged with driving -under the influence of alcohol, failing to signal and careless driv- ing. Price waived his right to a preliminary hearing before Dis- trict Justice James Tupper. ¢ Wyoming resident John B. Baines, 32, was arrested Jan. 31 by Dallas Township patrolman Jeffrey J. Dennis after police re- sponded to an accident on Rt. 309. Sharon J. Winter of Dallas told police that she was slowing down, with her blinker on, to pull into a mobile home park when she was hit from behind by Baines. Baines was taken to Wilkes- Barre General Hospital where his blood alcohol level was determined to be .185. He was charged with driving under the influence of al- cohol. A related charge of follow- ing too closely was dismissed. Baines waived his right to a preliminary hearing. * Wilkes-Barre resident John G. Paltanavich, 56, was arrested Feb. 15 by Kingston Township patrolman Wade Curtis after po- lice observed him driving errati- cally on Rt. 309. He was taken to the Luzerne County Central Processing Cen- ter where his blood alcohol level was determined to be .226, more than twice the legal limit of .10. Paltanavich waived his right to a preliminary hearing before District Justice James Tupper. * Sweet Valley resident Leonard Morris, 50, was arrested Feb. 6 by Kingston Township patrolman James Ibbotson after police ob- served him driving erratically on Hillside Rd. After failing field sobriety tests, he was taken to Wilkes-Barre Gen- eral Hospital where he refused a blood alcohol test. Refusal of the test results in a one-year license suspension. Morris was charged with driving under the influence of alcohol. Related charges of disregard for a traffic lane, care- less driving and improper signal- ing were dismissed. He waived his right to a pre- liminary hearing. * Harveys Lake resident Susan Callahan, 43, was arrested Feb. 15 by Dallas Borough patrolman - William Norris after police ob- served her driving erratically on Rt. 415. After failing field sobriety tests, she was taken to Wilkes-Barre General Hospital where her blood alcohol level was determined to be .187. She was charged with driving under the influence of al- cohol. Callahan waived her right to a preliminary hearing. * Hopatcong, New Jersey resi- dent Steven Mabry, 40, was ar- rested Jan. 30 by Kingston Town- ship patrolmanJames J. Ibbotson after police observed him driving erratically on Carverton Rd. He was charged with driving under the influence of alcohol and driving without a license. » Wilkes-Barre resident Jason Kohl, 21, was arrested Feb. 3 by Kingston Township patrolman James Ibbotson after police ob- served him driving erratically on Rt. 309. After failing field sobriety tests, he was taken to Wilkes-Barre Gen- eral Hospital where his blood al- cohol level was determined to be .133. He was charged with driving under the influence of alcohol and disregard for traffic lane. Kohl waived his right to a pre- liminary hearing. e Clarks Summit resident Jo- seph McGarry, 19, was arrested Dec. 9 by Harveys Lake patrolman James Karlowicz after police ob- served him driving erratically on Rt. 415 Lakeside Dr. After failing field sobriety tests, he was taken to Wilkes-Barre Gen- eral Hospital where his blood test proved positive for marijuana. Police found a bag of marijuana and a pipe with marijuana in it in the truck McGarry was driving. He was charged with driving un- der the influence of a controlled substance, failing to keep right and careless driving. He waived his right to a prelimi- nary hearing.
