2 The Dallas Post den Dallas, PA Wednesday, November 5, 1997 Le 5 a DISTRICT COURT BRIEFS 19-year-old confesses to breaking into Roll-A-Way three times v5 Pallas resident David Petrikonis, 19, was arrested Oct. 9 by Dallas Borough patrolman Jamies Drury after two men iden- tified him as the person who bur- gldrized the Roll-A-Way skating rink on Memorial Highway. On Oct. 4 police were notified that a glass door had been broken at the Roll-A-Way. Police noticed a door at the rink had been smashed. Police crawled through the opening in the glass door and disg¢evered several pinball ma- chines and a pool table had been broken into. _Approximately $450 was sto- len and no one was found inside they building. The glass door’s damage was estimated at $250. Police received a call from two males later that day who identi- fied Petrikonis as the burglar. Petrikonis asked the two males if they wanted to join him in bur- glarizing the skating rink, but they declined, said the men. After Petrikonis was arrested, he gave police a written confes- sion in which he admitted to rob- bing Roll-A-Way on Oct. 4 and two other occasions in March and April of 1996. He said no one assisted him. He was charged with burglary, criminal trespassing, criminal mischief, and theft by unlawful taking. D.U.I. CHARGES The following people waived their right to a preliminary hear- ing before District Justice James Tupper on Oct. 29: ¢ West Wyoming resident Alan R’ ‘Pietrowsky, 47, who was ar- rested Aug. 16 by Dallas Town- ship patrolman Robert Jolley af- tér he was stopped at a sobriety check point on Rt. 309. A breath test determined his blood alcohol level to be .148. He was charged with driving under the influence of alcohol. e Wilkes-Barre resident Tho- mas Norman, 45, who was ar- rested Aug. 15 by Jackson Town- ship patrolman David Kittle after police were called to a one-vehicle aceident at Chase Rd. and Hill- side Rd. «After failing field sobriety tests, Norman was taken to the Luzerne County Central Processing Cen- tex, where his blood alcohol was determined to be .257, more than twice legal limit of .10. ~-He was charged with driving under the influence of alcohol and driving with a suspended license. ° . Wilkes-Barre resident Kathy lamihski, 49, who was arrested Sept.. 1 by Kingston Township patrolman Wade Curtis after po- lice were called to an accident on Rt.309. : #" According to police reports Kaminski s car was traveling north pn Rt. 309 when she went off the roadway and struck a curb after passing Carverton Rd. Her car veered across the driving and passing lanes of northbound traf- fic, then over a cement median. Her car then went across south- bound lanes until she hit a ce- ment curb, and went up the curb into a grass embankment. It trav- elled 24 ft. on the embankment before it hit a utility pole. Her car then travelled another 106 ft. be- fore stopping. Kaminski was taken to the Wilkes-Barre General Hospital where her blood alcohol level was determined to be .240, more than twice the legal limit of .10. She was charged with driving under the influence of alcohol and careless driving. e Fort Lauderdale, FL resident James A. Ellsworth, 39, who was arrested by Dallas Township pa- trolman Jeffrey Dennis after po- lice observed him driving errati- cally on Main Rd. Ellsworth was driving in the oncoming traffic lane. After failing field sobriety tests he was taken to Wilkes-Barre - General Hospital where his blood alcohol level was determined to be .235, twice the legal limit of .10. He was charged with driving under the influence of alcohol and failing to keep right. ACCIDENT LEADS TO DRUG, DRIVING CHARGES Edwardsville resident Shawn Smith; 21, was arrested Aug. 2 by Harveys Lake Borough patrolman James Karlowicz after police re- sponded to an accident at Rt. 415 and Kunkle Rd. The car Smith and Michelle Dzubiak were driving in crossed yellow lines at the intersection and hit a pole. Kozemko said he did not know what Young was talking about when he asked him about the accident. . Kozemko was taken to Wilkes- Barre General Hospital where his blood alcohol level was determined to be .247, more than twice the legal limit of .10. He: also tested positive for marijuana after some was found on him at the accident. He was charged with driving under the influence of alcohol and marijuana, possession of mari- juana, careless driving and failing to keep right. A related charge of possession of drug paraphernalia ~ was dismissed. eo Wilkes-Barre resident Frank Belles, 21, who was arrested Aug. 17 by Dallas Township patrolman Brian Feeney after police observed him driving erratically on Lower Demunds Rd. After failing field sobriety tests he was taken to the Dallas Town- ship Police Department where his blood alcohol level was determined to be .273, twice the legal limit of 10. He was charged with driving under the influence of alcohol, driving with a suspended license and careless driving. A related charge of carrying a firearm with- out a permit was dismissed. * West Pittston resident Wayne A. Coyne, 26, who was arrested Aug. 16 by Dallas Borough pa- . trolman James Drury after police observed him driving erratically on Rt. 309. After failing field sobriety tests he was taken to Wilkes-Barre General Hospital where his blood alcohol level was determined to be 187, He was charged with driving under the influence of alcohol, careless driving and failing to sig- nal. A related charge of driving with a suspended license was dis- missed. Smith told police she was driving the car and that he told her to slow down. Later Smith told ambulance personnel that he could not lie anymore and that he was actually driving the car at the time of the accident. * Smith did not have a valid driver's license. A blood and urine test deter- mined Smith had cocaine and marijuana in his body. He was charged with driving under the influence of a controlled substance, driving without a li- cense, driving at an unsafe speed and causing an accident involv- ing injury. Related charges of failing to keep right, careless driv- ing and reckless driving were dis- ~ missed. Molestation suspect's case going to county court DALLAS - Robert Holeman, 53, waived his right to a preliminary hearing before District Justice James Tupper on October 30. Holeman has been in custody since his arrest for the alleged sexual molestation of a 12-year- old boy. Holeman applied for represen- tation twice and was denied twice. “Most (lawyers) are out of bounds financially,” Holeman told Tupper. “I will continue to look, but it’s best for me to waive the hearing at this time.” Tupper told him he will eventu- ally qualify with someone. “I sug- gest you contact every attorney in the yellow pages,” he said.
