Pennetti, ~ Philadelphia. 2 : The Dallas Post Dallas, PA Wednesday, June 4, 1997 DISTRICT COURT BRIEFS Driver gave false story, police say Shawanese resident Theresa 40, who was arrested March 9 by Dallas Borough pa- trolman James Martin after po- lice observed her driving errati- _ callyon Rt. 415, waived her right to a ‘preliminary hearing before District Justice James Tupper. When Martin asked for her driver's license Pennetti said she did not have it and told police her name was Ellen Pennetti with a birthdate of Jan. 1, 1952. She handed Martin a temporary regis- tration that showed the owner: of the vehicle to be Sidney Blaine of Shawanese. Martin called the name into the Back Mountain Communication Center, they found an Ellen Pennetti; but her birthdate was Jan. 1, 1955 and she lived in Martin asked Pennettiif she had recently moved; she said she had and never ~ changed it on her license. According to police reports, Martin began to get suspicious that she was giving him false in- formation regarding who shewas. He had the communication cen- ter call Blaine and ask who was driving his car. He stated that Theresa Pennetti was driving it. A check showed that her license had been suspended. Martin also had the plate num- ber and vehicle identification num- ber checked through the commu- nication center. The plate num- ber belonged to a Chevrolet with no title, no expiration and no year owned by Theresa Pennetti. The identification number was listed to belong to a Ford, owned by Blaine with title, but no expira- tion date. Upon closer inspection, police observed that a Feb. 1997 valida- tion sticker was on the license plate, but had an April 1996 sticker beneath it. Pennetti was charged with making false reports to law en- forcement, improper display of documents and driving with a suspended or revoked license. Two related charges were dis- missed. CHARGES e Forty-Fort resident Michael Kelly, 32, who was arrested Feb. 23 by Dallas Twp. patrolman Brian Feeney after police responded to an accident on Rt. 309, near Mark II restaurant. Kelly was one driver in the two car accident. Accord- ing to police reports, Kelly stag- gered when he walked and slurred his speech. After refusing to take field sobriety tests, Kelly also re- fused to take a blood alcohol test. He was charged with driving under the influence of alcohol and failing to use a safety belt. A related charge of careless driving was dismissed. * Harveys Lake resident Ronald Turner, 30, who was arrested on March 20 by Lake Twp. patrol- man John Fuches after police re- sponded to a one vehicle accident on Rt. 29. According to police reports, Turner's truck hit a util- ity pole, then drove up onto a guard rail before rolling over the bank. Turner was not present when police first came upon the scene, but returned shortly with mud on his clothing. When asked if he had been drinking since the acci- dent, he told police that he had been drinking prior to the acci- dent. A blood test showed his blood alcohol to be .12. A person is legally drunk with a blood alco- hol level of .10 or higher. He was charged with driving under the influence of alcohol, driving with a blood alcohol level of at least .10 and not driving at a safe speed. e Harveys Lake resident Lawrence Moretti, 39, who was arrested on March 15 by Harveys Lake patrolman James Karlowicz after police observed him driving erratically on Rt. 415. After fail- ing field sobriety tests, he took a blood test which showed his blood alcohol level to be .169. He was charged with driving under the influence of alcohol, driving with a blood alcohol level of .10 or higher, driving with a suspended or revoked license, operating vehicle without required registration, careless driving and ~ reckless driving. * Harveys Lake resident Leo P. Dean, 47, who was arrested March 2 by Dallas Twp. patrolman Jef- frey Dennis after police observed him driving erratically on Rt. 309. Police saw him drive into oncom- ing traffic, almost hitting other cars. When Dennis asked him for his driver's license he presented his Visa card before stating he did not have his license with him. After failing field sobriety tests, he took a blood test which showed his blood alcohol level to be .142. He was charged with driving un- der the influence of alcohol, driv- ing with a blood alcohol level of .10 or higher and disregarding a traffic lane. * Breinigsville resident Brian Woods, 30, who was arrested on Jan. 8 by Dallas Borough patrol- mandames Drury after police were called about a drunk and disor- derly man at Orloski’s in Dallas. While on their way to Orloski’s, police received a call that the man had just left and was driving south on Rt. 309 in a brown Oldsmobile. Police observed Woods driving erratically on Rt. 309. He was weaving in and out of his lane and almost struck a utility pole near Carverton Rd. After failing field sobriety tests, a blood test showed his blood alcohol level to be . 207. Police found an open bottle of Vodka and two empty 16 ounce cans of Busch beer in his car. He is charged with driving un- der the influence of alcohol, pub- lic drunkenness, careless driving and driving with a suspended or revoked license.
