Rentals Inc., DISTRICT COURT BRIEFS | D.U.I. CHARGES The following people waived their right to a preliminary hear- ing in front of District Justice James Tupper on March 30: * Hunlock Creek resident Clark Cavanaugh, 20, who was arrested by Dallas Borough patrolman James Martin April 10 after police observed him driving erratically on Rt. 309, Irem Rd. and Country Club Rd. Cavanaugh drove a white Oldsmobile Cutlass 65 miles per hour on Rt. 309. Cavanaugh did not stop his car after Martin acti- vated his warning lights and si- rens. He kept driving until he made a quick turn into Wedgwood Acres off Country Club Rd. and of lost control of the car. The car hit a temporary electrical service and was disabled. Cavanaugh then ran from the car into the woods. Martin radi- oed for backup and a K-9 unit to be brought in from the Wilkes- Barre police dept. ~ After checking the car's license number, it was found that the registration was temporarily is- sued on the used car. The carwas registered in Cavanaugh’s mother’s name. While police were searching the woods, Dallas Township officer Ruth Peters heard the description of Cavanaugh on the radio while she was on her way to Turkey Hill. Peters observed a man fitting Cavanaugh's description at the pay phone outside Turkey Hill. Police arrived and took him into custody. After a field sobriety test was inconclusive, Cavanaugh took a breath test which showed his blood alcohol level to be .049. Police found 13 full 12 oz. cans of beer in the Oldsmobile and two empty 12 oz. beers. Cavanaugh told police he had drank a six- pack of beer that night. He is charged with driving un- der the influence of alcohol, mi- nor driving under influence, dam- age to real estate property, ex- ceeding maximum speed and flee- ing police officers. Four related charges of failing to stop at stop sign, careless driving, driving with asuspended license and purchas- ing alcohol as a minor were dis- missed. e¢ Dallas resident Patrick McCue, 36, who was arrested Jan. 9 by Dallas Borough patrolman James Martin after police observed him driving erratically on Rt. 309. After failing field sobriety tests, McCue took a breath test which showed his blood alcohol level to be .201. He refused to take a blood test which resulted in the suspension of his license for one year. McCue was charged with driv- ing under the influence and care- less driving. ¢ Hazleton resident Jon Sosdjan, 47, who was arrested by PA State Trooper Christopher O'Brien March 2 after police re- sponded to a two-vehicle accident N.E. Sosdjan was charged with driv- ing under the influence of alcohol and failing to stop at a stop sign. A related charge was dismissed. * Wilkes-Barre resident Lucy Ciesla, 29, who was arrested by Kingston Township patrolman James Ibbotson April 16 after police observed her driving errati- cally on Rt. 309, Center St. and Main St. When Ibbotson asked Ciesla for her driver's license, she stated she wanted to speak with Joe Amato, her attorney. She did not respond to Ibbotson’s command that she step out of the car, in- stead she stared straight ahead and mumbled, according to police reports. She finally did step out of the car and told Ibbotson that she was leaving and did not have time to deal with the situation. Ibbotson held her arm and told her she could not leave because he wanted to see if she was able to drive, he then asked her if she would submit to field sobriety tests. She responded by striking Ibbotson in the chest and falling to the ground yelling for her law- yer. Ciesla kicked, struggled and screamed for police to let her go. She kicked Ibbotson in the shin and groin area. Backup officers arrived and restrained her hands. She was placed in the police car where she proceeded to kick the doors and window, according to police reports. Ciesla refused to take a blood alcohol test which results in sus- pension of the driver’s license for one year. She is charged with driving under the influence, three counts of simple assault, six counts of harrassment, resisting arrest and five counts of disorderly conduct. Related charges of aggravated assault and driving with a sus- pended license were dismissed. 16 Carverton Road, Trucksville call Ahead RCYe TEP [0] Eat in or Take Out Try Our Wings!
