Stepney, 22, 456 No. Main St., Wilkes-Barre, were charged by Dallas Borough police with bur- glary and criminal trespass in connection with a theft Oct. 25 at the Garvey residence at 76 High- land Blvd., Dallas. Appel also was charged with criminal conspiracy, theft and unauthorized use of an automobile. The investigation began after Dennis Garvey's employer received a phone call from Kaufman's De- partment Store at the Wyoming Valley Mall saying someone had attempted to use Garvey's store charge card without other identi- fication. Garvey was contacted in Arizona where he was traveling on business and told his employer the credit card should have been in his dresser at home. Dallas Borough officer Russell Devens reported he went to the home shortly after noon Oct. 25 to CHARGES DISMISSED The following charges were dis- missed because the alleged vic- - tims refused to prosecute: e Charges of burglary, criminal trespass, theft and criminal mis- chief against William L. Gaines, 20, 65 Sullivan St., Forty Fort, and Joseph A. Boback, 22, 32 Circle Dr., Dallas. Both had been charged after allegedly breaking into Boback's parents’ home April 1. e Charges of simple assault and . harassment against William Rusin Jr., 32, 270 Oldfield Rd. + Shavertown. Rusin had been check for signs of forced entry and . was greeted by Garvey's daugh- ter, Kaitlyn, who said she had stopped over to let a dog out. Garvey called while Devens was there, and asked Kaitlyn Garvey to check to see if his credit cards were missing. She found they were, along with jewelry and other items. When police at the Wyoming Valley Mall searched Stepney they found credit cards, four rings, some with Garvey's name in- scribed on them, and a small quantity of cash. After the Garveys returned from Arizona, they provided a list of several items that were missing, including six guns, jewelry and cash valued at over $13,000. The items had apparently been taken sometime during the early morn- ing hours of Oct. 25 after the defendants and other individuals had been in the home at an all- night party. charged after Coleen Walter said he had refused to allow her out of his car Sept. 1, then struck her causing bruising to her face and hands. DRUG CHARGE Christopher J. Morris, 21, of 211 Parrish St., Dallas, waived his right to a preliminary hearing Nov. 7 before District Justice James Tupper. Morris was charged after and ambulance was dispatched to his home to treat a reported drug overdose.
