Lake Twp. recycling center open April 13 The Lake Township Recycling Center will be open Saturday, April 13, from 10-12 noon, accepting aluminum and bi-metal cans, clear, brown and green glass. DISTRICT COURT BRIEFS - : Pair charged in burglary, more charges pending Dallas Township resident Jo- seph Andrew Boback, 31, and Forty Fort resident William Leonard Gaines, 29, were charged April 3 with burglary, criminal trespass, theft by unlawful taking and criminal mischief in the April 1 burglary of Boback’s parents’ home at College Manor. Additional charges against the pair and a third suspect, Swoyersville resident Brad Lopuhosky, who has not yet been charged, are pending, according tc Forty Fort patrolman Eric Morgantini. According to arrest warrant affidavits on file at District Jus- tice James Tupper's office, Boback's parents, Joseph and Kathy Boback, discovered their home had been broken into when they returned from work. The glass sliding door had been forced open and the inside frame and window treatment were destroyed. A locked bedroom door had also been forced open. Removed were personal items belonging to their son, including a pair of leather moccasins, two gold necklaces, a hunter green jacket, a car key and a book of checks. The Bobacks identified their son as a suspect and told police D.U.I. CHARGES SENT TO COUNTY COURT Courtdale resident Fred Davis, 59, and Harveys Lake resident Edward Ungvarsky, 38, waived their rights to preliminary hear- ings on charges of D.U.I April 4 before District Justice James Tupper. » Davis was arrested Feb. 10 by Kingston Township officer James Ibbotson after Ibbotson observed him driving erratically on Route 309. Police followed him south on the highway through the rock cuts to the parking lot of Wasserott's, . where Ibbotson and police from Luzerne and Courtdale pulled him over. : He refused to perform field so- briety tests. A blood test showed his blood alcohol level to be .211, more than twice the legal limit of 10. A related citation for careless driving was dismissed, according to court records. Davis was repre- he knows he isn't allowed on the property. The investigation revealed that Boback and Gaines were. seen carrying several bags of items from the College Manor home by the young woman who gave them a ride from Dallas to Gaines's home in Forty Fort at approximately 3:30 p.m. April 1. They left the bags at Gaines’s Sullivan St. home. When police served search and | arrest warrants on the pair at Gaines's home, they also seized small amounts of suspected nar- cotics which field tested positive for marijuana and cocaine, nu- merous syringes, pipes contain- ing residue and other drug para- phernalia. Police also found a small amount of suspected marijuana and a syringe on Lopuhosky, who has not yet been charged in the incident. All evidence has been sent to the State Police crime lab for analysis. Police recovered the moccasins, car key and jacket from the home, but the necklaces and book of checks weren't accounted for. Assisting in the investigation were police from Swoyersville, Kingston and Forty Fort, and the .State Police Research and Identi- fication Unit. _ sented by attorney Bruce Anders. e Ungvarsky was arrested Feb, 19 by Pennsylvania State Police Trooper Joseph Wasko after Ungvarsky was involved in a one- car accident on Hillside Road in Jackson Twp. : After failing field sobriety tests, he took a blood test which showed his blood alcohol level to be .1883. Represented by attorney Basil Russin, Ungvarsky is free on $300 bail. Related citations for careless driving, driving at an unsafe speed and failing to stay in the proper driving lane were dismissed, ac- cording to court records. CHARGES DISMISSED Charges of writing bad checks and theft by deception against Dallas Township resident Paulette Huey, 50, were dismissed after she paid full restitution to the complainant, who decided not to prosecute the case further, ac- cording to court records.
