2 The Dallas Post Dallas, PA Wednesday, November 15, 1995 DISTRICT COURT BRIEFS Woman to be tried for forgery Multiple charges of forgery, theft by deception and receiving stolen property against Shaver- town resident Stephanie Siegel, 19, were waived to Luzerne County Criminal Court after a prelimi- nary hearing November 9 before District Justice James Tupper. ‘The charges stemmed from an incident September 29, in which Thomas Mertz, the manager of Mr. Z's supermarket in Dallas, reported to police that Siegel had cashed two checks belonging to Linda Murphy for $250 each, according to court records. ‘The manager of Insalaco’s Supermarket in Shavertown also reported to police that Siegel had cashed a check for $49.50 there. Siegel admitted cashing the checks and told police a man named Alfredo gave them to her, promising her some of the money in return. Police learned the checks had been stolen September 26 from Murphy's residence in Wappin- ger's Falls, NY. Represented by attorney Jo- seph Sklarosky, Jr., Siegel is lodged in the Luzerne County Prison in default of $10,000 bail. The arresting officers were Dallas Borough patrolman Russell Devens and Kingston Township patrolman Wade Curtis. TAKING BMW LANDS MAN IN HOT WATER Tunkhannock resident Mark Culver, 26, waived his right toa preliminary hearing November 9 before District Justice James Tupper on charges of unauthor- ized use of a vehicle and receiving stolen property. Additional charges of theft by unlawful taking were dismissed, according to court records. The charges stemmed from incidents July 7, in which Culver allegedly stole a BMW valued at $60,000 belonging to Richard Angelicola from Pickett’s Charge Restaurant and rolled it over sev- eral times in an accident on Route 292 in Wyoming County. The same day, Culver also al- DUI CHARGED Dallas resident Joseph M. Smee, 43, waived his right to a preliminary hearing November 9 before District Justice James Tupper on charges of driving while under the influence. After failing field sobriety tests, Smee took a blood test which showed his blood alcohol level to be .266, more than twice the legal limit of .10. Other D.U.L charges and cita- tions for not carrying a driver's license while driving and failure to use a seat belt were dismissed, ~ according to court records. The charges stemmed from an incident August 29, in which police observed Smee driving erratically on Route 309 in Dallas Township. A second set of D.U.L charges, from an incident September 10 in which Smee nearly ran his truck over an embankment alonga road in ‘Franklin Township and fell asleep before the Pennsylvania ‘State Police arrived on the scene, were dismissed. . Ablood test blood test showed his blood alcohol level to be .4, four times the legal limit. + Represented by publicdefender Gerald Deady, Smee is free on $500 bail. TO STAND TRIAL FOR BURGLARY, TRESPASS Michael Yanchulis, 21, with no current address, waived his right to a preliminary hearing Novem- ber 9before District Justice James Tupper on charges of burglary, legedly removed a stereo/CD player, a CD, a watch and vehicle ownership cards and damaged the glove box from a Volkswagen be- longing to Heather Lawley, and also removed a stereo and numer- ous cassette tapes from a car belonging to Michele Geise. Both vehicles had been parked at area businesses. Represented by attorney Steve Urbanski, Culver is lodged in the Luzerne County Prison in default of $12,500 bail. Dallas Borough patrolmen- James Drury, James Martin and Russell Devens investigated the incidents. criminal trespass and theft by unlawful taking. The charges stemmed from an incident in which Yanchulis al- legedly removed a bottle of soda and two large packages of ham- burger from the refrigerator of a Lower Demunds Road home. Represented by attorney Jo- seph Sklarosky, Yanchulis is lodged in the Luzerne County Prison in default of $5,000 bail. Dallas Township patrolman Robert Jolley, assisted by King- ston Township patrolmen Wade Curtis and Charles Rauschkolb, investigated the incident. FOOD FIGHT LEADS TO COURT CASE A charge of simple assault against Stanley Kwastavich, 38, of Trucksville, was sent to Luzerne County Criminal Court after a preliminary hearing November 9 before District Justice James Tupper. The charge resulted rok an incident in which Kwastavich hit . his brother, Peter Kwastavich, during an argument over the purchase of food. Peter Kwastavich sustained a bloody nose and had his hair pulled during the alterca- tion. Represented by attorney Sam Falcone, Stanley Kwastavich is free on $1,000 bail. Mrs. Elston is a member of the Huntsville United Methodist Church, where she taught Sunday School for many years, United Methodist Women, Nesbitt Memorial Hospital Auxiliary and the Wyoming Conference Historical Society. She is a direct descendant of the Rev. Jacob Johnson, who was Wyoming Valley's first settled minister in 1772. Her son, Harold, lives on Reservoir Road, Huntsville, and daughter, Nancy, in State College. She has six grandchildren: David, Robert, Dale and Paul Elston, Eric and Heather Schimmel; nine great-grand- children (two in heaven); one great-great-grandson and several nieces and nephews.
