Related charges of D.U.I. were dismissed, according to court records. The charges resulted from an incident in which police observed Culver driving erratically on Route 309, where he pulled onto the berm of the roadway and at- tempted to switch places inside the car with a passenger, Marian Kenney, who is the car's owner. Police found a marijuana bowl on Culver during a routine search and a second pipe in the car. After failing field sobriety tests, he re- fused to take a blood alcohol test, which'will result in his losing his driver's license for a year under the state Implied Consent Law. He was then arrested on an outstanding warrant from Dallas Borough for receiving stolen prop- erty. Represented by attorney Ste- yen! Walker, 32, was arrested June 9 after corrections officers found two hand-rolled cigarettes in his right sock during a routine strip search in the B- block shower rooms. The ciga- rettes tested positive for mari- juana. Walker told officers he had traded three packs of cigarettes to an inmate from C-block for the marijuana. He waived his right to a preliminary hearing. Eugene Robinson, 50, pled guilty to possession of marijuana after corrections officers arrested him June 6 during a routine strip search in the inmates’ changing room. Officers found two packets containing 2.1 grams of marijuana in his right sock. Robinson told officers he was bringing the marijuana to another inmate, who was supposed to give him one of the bags for himself. Robinson will serve an addi- tional 10 to 20 days after his original sentence is completed. D.U.I. CHARGES SENT TO COUNTY COURT Herbert Lee, 46, of Dallas waived his right to a preliminary hearing on charges of driving while under the influence and fleeing police pursuit October 25 before District Justice James Tupper. He was also cited for reckless driving. The charge resulted from a. incident in which Harveys Lake police observed Lee driving errat- ically on Lakeside Drive, nearly colliding with the cruiser at one point, and pursued him to a dirt road, where he stopped at a trailer home. He was uncooperative with police during the arrest and ac- cused police of harassing him. After failing field sobriety tests, Lee took a blood test which showed his blood alcohol level to be .255, more than twice the legal limit of .1 percent. He was represented by attorney Michael Mey and is free on $300 bail. PLEADS GUILTY TO PASSING BAD CHECK Harveys Lake resident Joseph Smith pled guilty to passing a bad check at a preliminary hearing October 27 before District Justice James Tupper. The charge resulted from an incident March 16, in which Smith bought a snowblower from Lehman Power Equipment and paid for it with a check drawn against a closed bank account. Although Smith promised to bring the money in to cover the check, but never paid the com- pany, according to court records. He must paya $200 fine, $81 in court costs and restitution of $796. Lehman, Franklin, Jackson and Ross townships and Harveys Lake didn't donate anything last year, while Lake township had sent the library $500. Although Lake-Lehman couldn't contribute the full $4,600 the library. had asked for, it in- creased its share by $700 to $3,700. Still pending are donations from Franklin, Dallas and Kingston townships, which are still work- ing on their preliminary budgets, Rosenthal said. Dallas Township has been asked for $4,400, while Kingston Township has been asked for $2,700 and Franklin Township, $400. Jackson Township was the only municipality to turn down the library's request. “We suggested holding a fun- draiser for the library in the town- ship — something like an ox or pig roast,” said supervisors’ chairman . Walter Glogowski. “So far nobody has come back to us to volunteer their services or to help explore a location with kitchens and ample seating. Well-supported libraries receive more state money than their poorer cousins. In order to make up the entire $240,000 library budget through a special property tax, as is being done in Lackawanna County and is being considered in Wyoming County, homeowners would pay an additional .296 mills, Rosen- thal estimated. “A one-mill library tax in the Back Mountain would generate $810,000 - enough to build a 12- story library,” he said.
