According to professional ur- ban planner Marlene Pawlowski, author of the original ordinance, most changes deal with proce- dures for the zoning hearing board and advertising hearings. “In terms of local policy, not much will be different,” she said. “The updates are necessary to bring local zoning ordinances into compliance with the state Mu- nicipal Planning Code.” The zoning map hasn't been changed at all, Pawlowski said. In addition to agricultural, residential (single family, two family and multi-family dwellings), special (for Chase Prison), and mining (American Asphalt’s quarry on Chase Road), the busi- western end of the township, in the vicinity of Shuldice, Smith Pond and Shady Hill roads. “I had originally suggested it because the area was reasonably flat and developable,” Pawlowski said. “It looked like a good buffer area between the prison and the residences. The only industry there now is a junk yard.” According to the zoning map, the conservation districts are on Plymouth /Larksville Mountain, an area too steep for develop- ment, and around the Ceasetown Dam. The two business districts are on Chase Road alongside the fire hall and a small area on Chase Road west of the industrial dis- trict. Pawlowski said. DOVE Post Staff Harveys Lake residents will find few changes in the borough's updated zoning ordinance, which has been sent to the Luzerne County Planning Commission for comment. According to the borough's codes enforcement officer Paul Grimes, the ordinance, first en- acted in 1974, was revised mainly to conform to the new state plan- ning code. Municipal planner Jack Var- aly, who wrote the revisions, said that language pertaining to ad- vertising procedures and public notices and definitions required by the Federal Emergency Man- agement Agency (FEMA) were changed to fit the state code. The FEMA changes mainly deal with flood plain management requirements and wetlands, Var- aly said. FEMA has specific require- ments for homes built on flood plains, requiring that they have AAAS ISIS SIS TIS HILL special louvers which allow flood water to enter and drain out built into their foundations. Homes built on flood plains also are not allowed to have living space on any floors which have previously been flooded, Varaly said. Harveys Lake's wetlands ordi- nance will use wetlands defini- tions compiled by the U.S. De- partment of the Interior, which defines wetlands according to their vegetation, soil type and hydrol- ogy, Varaly said. "The only other change that I made was to rearrange the ordi- nance by topic to make it more comprehensible,” he said. For example, Varaly said that under the original ordinance, in- formation on parking regulations was divided among several differ- ent sections, making it very con- fusing. Now that the ordinance has been rearranged by subject, all regulations covering one topic are found in the same section. No new regulations have been adopted and no zoning map changes are anticipated, Grimes said. After the borough receives the proposed ordinance and com- ments back from Luzerne County, it will be sent to the Harveys Lake planning commission for review. The borough council will then schedule a public hearing for input from residents on the ordinance.
