Schwartz was found guilty of first degree murder Monday, May 11, by Luzerne CountyJudge Hugh Mundy. Schwartz will spend the rest of his life in prison without chance for parole. Schwartz pleaded guilty to the general charge of homicide before Mundy on May 4. Schwartz, 29, of Dallas Town- ship shot to death his former girl- friend Deborah Van Leuven, 27, of Lake Ariel, on January 27. Van Leuven was shot when she ar- rived his parents’ home on Wind- sor Drive with their 2-year-old daughter, Stephanie, to honor his visitation rights. Mundy also found Schwartz guilty of theft and receiving sto- len property for fleeing in Van Leuven's car with her credit cars after the shooting, and also for taking the the handgun used to the commit the murder from another girlfriend. Mundy dismissed the recklessly endangering charge against Schwartz which was filed because Schwartz allegedly endangered the child, who witnessed the shoot- ing. After the verdict, District Attorney Peter Paul Olszewski said he would not seek the death penalty. Olszewski earlier had said he would seek the death pen- alty because the shooting endan- gered the child, and that when Schwartz killed Van Leuven, he murdered a witness who was to testify at a criminal trial against him.
