Lowe, M.D. Gary Nothstein, D.O. — — Stephen Schwartz pleads guilty to homicide Stephen G. Schwartz pleaded guilty to the general charge of homicide before Judge Hugh Mundy in Luzerne County Court May 4. Schwartz, 29, of Dallas Town- ship, shot to death his former girl- friend Deborah Van Leuven, 27, of Lake Ariel, on January 27. Van Leuven was shot at least three times, twice in the face, while their 2-year-old daughter, Stephanie, watched. The shooting occurred when she arrived at Schwartz's parents’ home on Windsor Drive with Stephanie to honor his visita- tion rights. The guilty plea leaves it up to Judge Mundy to determine the degree of homicide, and the pen- alty, which ranges from 5 to 10 years in prison to execution. District Attorney Peter Paul Olszewski has said he would seek the death penalty because of two aggravating circumstances; that the shooting endangered the child, and that when Schwartz allegedly killed Van Leuven, he murdered a witness who was to testify at a criminal trial against him. In May of 1991, Schwartz had chased Deborah Van Leuven’s car on Route 315 while brandishing a gun, and was then involved in an autoaccident. He was charged with recklessly endangering another person, leaving the scene of an accident, risking a catastrophe, and carrying an unlicensed gun. He was released on $50,000 bail after the incident on the condition that he have no contact with Van Leuven. Schwartz was captured three days after the January 27 shoot- ing when when he shot himself in the head at a Wilkes-Barre motel in an apparent attempt to commit suicide. Schwartz also waived his right to a jury trial on the charges of reckless endangerment, theft and receiving stolen property, leaving it to Mundy to decide his guilt or innocence. After the shooting, police allege that Schwartz fled in Van Leuven’s car with her credit cards. Schwartz is also alleged to have stolen the handgun used to the commit the murder from another girlfriend. Schwartz is now being held at the Luzerne County Correctional Facility without bail.
