Deer Meadow zoning passes court challenge BY CHARLOT M. DENMON Staff Writer In a decision handed down in Luzerne County Court last week by Judge Patrick J. Toole, Jr., the appeal of rezoning-land for the Deer Meadow development filed by the Dallas Borough Preserva- tion Association was dismissed. The judge dismissed the appeal because he believed the borough council followed its zoning ordi- nance which required public noti- fication of zoning changes. In his decision Toole stated that failure to provide such notifi- cation does not invalidate any recommendations adopted the statute. The appeal contended that Robert and Beverly Jones, mem- bers of the association, with prop- erty bordering Deer Meadows, were not notified of a Dallas Borough Council meeting to discuss chang- ing the Deer Meadows tract of land from conservation zoning to resi- dential. Under conservation zoning, lots’ must be a minimum of two acres.
