the Dallas School District, at a regular meeting held on March 12th,
1984, passed the following Resolution with jesnect to the sale of
certain Dallas School District real property by sealed bids;
1. By resolution dated June 30th, 1983, in accordance with Section
707 of the Pennsylvania Public School Code of 1949, as amended,
Dallas. School District declared and deemed as unused and
unnecessary for any purpose whatsover by Dallas School District
those certain premises situate in the Township of Kingston, Luzerne
County, Pennsylvania formerly known and designated as ''‘The
“Trucksville Elementary School’, comer of Oak
Street, Village of Trucksville, Kingston Township, Luzerne County,
fennsyienia, together with all buildings and improvements erected
ereon.
2. The premises are bounded and described as follows:
ALL that certain piece or parcel of land situated in the Township of
Kingston, County of Luzerne and State of Pennsylvania, more
particularly bounded and described as follows:
EGINNING at a P.K. nail corner situated at the intersection of the
westerly right-of-way line of Grove Street with the northerly right-of-
way line of Oak Lane, said point also being the most southerly corner
of Lot No. 25 of a plot of lots hereinafter mentioned;
THENCE along the northerly right-of-way line of Oak Lane North
forty-four degrees Monty ive minutes West (N 44 degrees 25' W) two

3. Pursuant to Section 707(2) of the Public School code of 1949,
Act of March 10th, 1949, P.L. 30, Article VII, 24 Pa.S.7-707, as
amended, the Dallas School District shall sell and otherwise convey
said premises by sealed bids.
4. Pursuant to Section 707(1) of the Public School Code of 1949, as
amended, the Secretary of the Dallas School District shall cause to
be published a request for sealed bids for the purchase of the
aforesaid premises and improvements erected thereon if any, upon
the terms and conditions set forth below, in the WILKES BARRE
TIMES LEADER, CITIZENS’ VOICE, THE DALLAS POST AND THE
LUZERNE LEGAL REGISTER, once a week for three (3) successive
weeks and by posting at least two (2) handbills on the premises to be
sold and posting at conspicuous places within the vicinity of said real
Sale 2 sear) five (5) handbills, commencing in the week of March
5. The terms and conditions of the sale of the aforesaid realty are
as follows:
a. All bids for purchase shall be securely. sealed and delivered to
the Secretary of Dallas School District, Administration Building,
Church Street, Dallas, Pennsylvania 18612 on or before 4:00 o'clock
PM (E.S.T.) on April 9th, 1984.
b. The premises shall be sold as a whole and not divided or
otherwise separated in any manner whatsoever. The premises shall be
sold free and clear of all liens and encumbrances and subject to any
exceptions, reservations, conditions, convenants, prior conveyances,
and proceedings by eminent domain as may appear in the line of title.
Conveyance of title shall be by Quitclaim Deed.
c. All bids shall represent the net consideration for such sale. All
real estate transfer taxes, assessments and other like charges shall
be borne exclusively by the successful bidder, and there shall be no
apportionment of the same at the time of ‘setflement.
d. The Board of Directors of Dallas School District reserves the
unqualified right and privilege, in its sole discretion, to accept or
fSject any bid submitted for the purchase of said realty, without cause
stated.
e. All sealed bids shall be opened at a regular public meeting of the
Board of Directors of the Dallas School District held on April 9th, 1984
at 8:00 o'clock PM (E.S.T.) to be held in the Administration Building,
Meeting Room, Church Street, Dallas, Pennsylvania.
f. Each bid must be accompanied by a bank cashier's or treasurer's
check payable to DALLAS SCHOOL DISTRICT in a sum equal to ten
per centum (10 percent) of the amount of the bid to secure the Dallas
School District against any loss resulting from the failure of the bidder
to comply with the terms of his bid, which said sum shall be retained
as a deposit toward the purchase price of the successful bidder, and
in the event of failure to make a settlement within thirty (30) days of
the acceptance of the bid, it shall be forfeited as liquidated mages.
Said really shall be sold ‘as is'', and any bidder shall be deemed to
have made an Pspection of the premises prior to submitting his bid.
The successful bidder shall, in addition to the amount of his bid, pay
any Pennsylvania and Dallas Township and Dallas School District
realty transfer taxes, registration and recording. costs and any real
estate broker's commission, if any. Property taxes, if any, shall be
apportioned as of settlement. Dallas School District shall not be
responsible for payment of any real estate broker's commission, if
any.
9. Settlement shall take place within thirty (30) days from the Dallas
School District's Board's acceptance of the highest responsible bid.
Title and possession shall pass at the time of settlement.
h. No bid in an amount less than $50,000.00 Dollars shall be
accepted by the Board of Directors of Dallas School District for the
purchase of the said premises.
+i. The monies derived from the sale-of the aforesaid realty shall be

regular meeting held on March 12th, 1984, passed the following Resolution with respect to the sale of
certain Dallas School District real property by sealed bids:
1. A portion of the premises situate on Westminster Drive, Orchard View Terrace, Dallas Township,
Luzerne County, Pennsylvania, described in Luzerne County Deed Book 1908 at Page 1095 owhed by
Dallas School District is hereby declared and deemed as unused and unnecessary for any purpose:
whatsoever by Dallas School District, under Section 707 of the Pennsylvania Public School Code of 1949,
as amended. v
2. The premises are bounded and described as follows: ‘
ALL that certain surface and right of soil only of and to that parcel of land situate in Dallas Township,
Luzerne County, Pennsylvania, bounded and described as follows:
BEGINNING at a point in the northwesterly side line of fifty (50) foot wide Westminster Drive and in the
line petsen Lots Nos. 20 and 21 of plot of lots known as ‘‘Orchard View Terrace’ hereinafter
mentioned; .
THENCE along sald dividing line North 26 degrees 26 minutes West one hundred fifty (150) feet to a
point in the southeasterly side line of lands of the Dallas School District Authority;
THENCE along line .of said lands North 63 degrees 34 minutes East one hundred forty-four and sixty-
three hundredths (144.63) feet to a point in the westerly or rear line of lands of the Dallas Water
mpany;
THENCE along line of said lands South 08 degrees 26 minutes East thirty-six and thirty-six hundredths
Beet to a point in the northerly or rear line of Lot No. 22 of said plot of lots; : :
THENCE along the northerly or reat line of Lot No. 22, North 88 degrees, 26 minutes West fifteen and
ninety-three hundredths (15.93) feet to a point in the westerly side line of said lot;

BEING all of Lot No. 21 of the “Orchard View Tertrace'’ plot of lots as developed by the Sturdevant
Dilley Enginesring Co., Ltd., of Wilkes-Barre, Pa., a map of said plot being on-file in the Office of said

TOGETHER with an easement of ingress, egress and regress in, over and upon the roadway fronting
the above-described lot, over the following piece or parcel of ground: -. :
BEGINNING at a point in the northwesterly side line of fifty (50) foot wide Westminster Drive and in line
between Lots Nos. 20 and 21 of plot of lots known as *‘Orchard View Terrace" hereinafter mentioned;

Drive by a curve to the right in a northeasterly direction an arc distance of eighty-two and seven

BEING all of that portion of the proposed northeastwardly extension of Westminster Drive which fronts
Lot No. 21 of the *‘Orchard View Terrace plot of lots as developed by the Sturdevant Dilley Engineering
Co., Ltd., of Wilkes-Barre, Pa., a map of said plot being on file in the office of said company and with the
Township of Dallas Planning Commission.
EXCEPTING and reserving therefrom unto Dallas School District, its successors and. assigns, an
easement for the purposes of the maintenance and repair of a sewer line, the parcel of land being
bounded and described as follows:
BEGINNING at a point in the northwesterly side line of fifty (50) foot wide Westminster Drive between
Lots Nos. 20 and 21 of plot of lots known as ‘‘Orchard View Terrace'’; ’
THENCE along the said dividing line North 26 degrees 26 minutes East one hundred fifty (150) feet to a
point in the southeasterly side line of lands of the Dallas School District Authority; 1
THENCE along the line of said lands North 63 degrees 34 minutes East twenty (20) feet to a point; ae
THENCE South 26 degrees 26 minutes East one hundred fifty and forty-eight hundredths (150.48) feet
to a point in the northwesterly side line of Westminster Drive;
THENCE South 26 degrees 26 minutes East fifty (50) feet across the proposed extension. of
Westminster Drive to the southeasterly side line of Westminster Drive.
THENCE along the southeasterly side of line of Westminster Drive twenty (20) feet to a point;
THENCE recrossing Westminster Drive North 26 degrees 26 minutes East fifty (50) feet to a point, the

SUBJECT to the same exceptions, reservations, restrictions, conditions, easements, etc., as more fully
set forth in the line of title. :
Article VII, 24 Pa. S. 7-707, as amended, the Dallas School District shall sell and otherwise’ convey said
premises by sealed bids. h
4. Pursuant to Section 707(1) of the Public School Code of 1949, as amended, the Secretary of the
Dallas School District shall cause to be published a request for sealed bids for the purchase of the
aforesaid premises and improvements erected thereon if any, upon the terms and conditions set forth
below, in the WILKES-BARRE TIMES LEADER, CITIZENS’ VOICE, THE DALLAS POST and THE LUZERNE
LEGAL REGISTER, once a week for three (3) successive weeks and by posting at least two (2) handbills
on the premises to be sold and posting at conspicuous places withingthe vicinity of said real estate at
least five (5) handbills, commencing in the week of March 12th, 1984.
5. The terms and conditions of the sale of the aforesaid realty are as follows: :
a. All bids for purchase shall be securely sealed and delivered to the Secretary of Dallas School
District, Administration Buidling, Church Street, Dallas, Pennsylvania 18612 on or before 4:00 o'clock PM
€s.) on April 9th, 1984.
b. The premises shall be sold as a whole and not divided or otherwise separated. in any manner
whatsoever. The premises shall be sold free and clear of all liens and encumbrances and subject to any
exceptions, reservations, conditions, covenants, prior conveyances, and proceedings by eminent domain
as may appear in the line of title. Conveyance of title shall be by Quitclaim Deed.
c. All bids shall represent the net consideration for such sale. All real estate transfer taxes,
assessments and other like charges shall be borne exclusively by the successful bidder, and there shall
be no apportionment of the same at the time of settlement.
d. The Board of Directors of Dallas School District reserves the unqualified right and privilege, in its
Sos Jisgrevion, to accept or reject any bid submitted for the purchase of said realty, without cause
stated. / 3
e. All sealed bids shall be opened at a regular public mesing of the Board of Directors of the Dallas
School District held on April 9th, 1984 at 8:00 o'clock PM (E.S.T.) to be held in the Administration
Buidling, Meeting Room, Church Street, Dallas, Pennsylvania.
. Each bid must be accompanied by a bank cashier's or treasurer's check payable to DALLAS
SCHOOL DISTRICT in a sum equal to ten per centum (10 Sicent of the amount of the bid to secure the
Dallas School District against any loss resulting from the failure of the bidder to comply with the terms of
his bid, which said sum shall be retained as a deposit toward the purchase Pics of the successful.
bidder, and in the event of failure to make a settlement within thirty { 0) days of the acceptance of the
bid, it shall be forfeited as liquidated damages. Said realty shall be sold “as is'’, and any bidder shall be
deemed to have made an inspection of the premises prior to submitting his bid. The ‘successful bidder
shall, in addition to the amount of his bid, pay any Pennsylvania and Dallas Township and Dalls School
District realty transfer taxes, registration and recording costs and any real estate broker's commission, if
any. Property taxes, if any, shall be apportioned as of settiement.” Dallas School District shall not. be
responsible for payment of any real estate broker's commission, if any. Y :
g. Settlement shall take place within thirty (30) days from the Dallas School District's Board's
acceptance of the highest responsible bid. Title’and possession shall pass at the time of settlement.
h. No bid in an amount less than $10,000.00 Dollars: shall be accepted by the Board of Directors of -
