Every person utilizing any direct communication, burgular, or fire alarm system connected with, or which when activated, would cause the telephone to be rung in, the police station of the Police Department of the Township of Dallas shall pay annually to the Township of Dallas for the benefits and advantages received, a license fee according to the following schedule: a. The Township of Dallas and its Police Department shall have the right to inspect at reasonable times the connection, operation, and maintenance of any alarm system connected with, or which, when activated, would cause the telephone to be rung in, the police station of the Police Department of Dallas. SECTION 7. The installation of alarm system without a license and without the payment of a license fee under this ordinance and any other violation of this or- dinance shall be punishable by a fine of not less than $100 and not more than $300, to be collected by a Summary Proceeding to be brought by Dallas Township before any Magistrate. SECTION 8. In this ordinance the word “‘person’’ shall be deemed to include any individual, establishment, partnership, corporation, or other organization utilizing any alarm system In all cases, the owner of the premises in which the alarm system is installed shall be responsible for the payment of license fees and other charges as set forth in this ordinance. SECTION 9. This ordinance shall take effect on the first day of May, 1978, and license fees for the year 1978 will not be delinquent until after the 31st day of May, 1978. BE IT ENACTED by the Council of the Borough of Harveys Lake, as follows: SECTION 1. COMMISSION ESTABLISHED Under the provisions of the Pen- nsylvania Municipalities Planning Code (Act of July 31, 1968, P.L. 805, 53 P.S. 10101, et seq.), there is hereby established the Harveys Lake Planning Commission, hereinafter referred to as the “"Commission’’ SECTION 2 COMPOSITION. The Commission shal be composed of seven (7) members, who shall be ap- pointed y the Borough Council, subject to the following qualifications: (A) All members of the Com- mission shall be a resident of the Borough of Harveys Lake. (B) At least five (5) members of the Commission designated as citizen members shall not be of- ficers or employees of the Borough of Harveys Lake. SECTION 3 INELIBIBILITY. Failure to maintain a residence in the Borough of Harveys Lake, shall render a member of such Commission ineligible to continue his membership therein. SECTION 4 TERMS OF OFFICE. (A) The initial members of the Commission shall serve the following terms: The first and second named members shall serve for a term of four (4) years; the third and fourth named members shall serve for a term of three (3) years; and fifth, and sixth named members shall serve for a term of two (2) years and the seventh named member shall serve for a term of one (1) year, or in each case, until their respective suc- cessors have been appointed and qualified. (B) All subsequently appointed members to said Commission, shall serve for terms of four (4) years, or until their successors are appointed and qualified. SECTION 5 COMPENSATION All members of the Commission shall serve without compensation, but may be reimbursed for necessary and reasonable expenses incurred in carrying out their Commission duties. SECTION 6 ADMINISTRATIVE AND TECHNICAL ASSISTANCE The Commission may, with the consent of the Borough Council and Borough Of- ficers employ and utilize such other ser- vices as may be necessary, and utilize Borough Officers, and employees in carrying out their powers and duties. SECTION 7 RECEIPT AND EX- PENDITURES OF MONEYS. In carrying out their powers and duties, the Commission may receive and expend any gifts, grants, appropriations of money from any source, including; Federal, Commonwealth or Local funds, and may contract with governmental or respect thereto; provided such funds are appropriated for use of the Commission by the Agency Controlling such funds. SECTION 8 POWERS AND DUTIES () The Commission shall main- tain ond keep on file records of its action. (B) The Commission shall make an Annual Report to the Borough Council of its activities and such other interim reports as may be request of it by the Borough Council. (C) The Commission is em- powered to administer the Har- veys Lake Subdivision Or- dinance. (D) The Commission shall make such recommendations and per- form such activities as is requested by the Borough Coun- cil, consistent with the Pen- nsylvania Municipalities Plan- ning Code. SECTION 9 ABOLITION OF THE PLAN. NING COMMITTEE. Upon the organization of the Planning Commission, created by this Ordinance, the Planning Committee established by prior legislation is abolished. All power and duties previously vested in the Plan- ning Committee is hereby vested in the Commission created by this Ordinance. SECTION 10 SEVERABILITY Should any portion or provision what- soever of this Ordinance be determined to be invalid or uneforceable by any Court of competent jurisdiction, such portion shall be deemed severable but only to the extent of such holding shall not affect the remaining portions hereof. SECTION 11 REPEALER All Ordinances or parts of Ordinances inconsistent herewith be and the same| are hereby repealed.
