DEFINITIONS The following words, terms and phrases, when used in this ordinance, unless the context clearly indicates otherwise, shall have the following meanings ascribed to them: A. PERSON—Any individual, partnership, association, syn- dicate, company, firm, trust, corporation, department, bureau, agency or other entity recognized by law as the subject of rights and duties. B. REFUSE-—Garbage, rubbish and trade waste. a. GARBAGE-All put- rescible animal and vegetable matter resulting from the hand- ling, preparation, cooking and consumption of food. b. RUBBISH-Solids not con- sidered to be highly flammable or explosive, including but not limited to rags, old clothes, leather, rubber, carpets, wood, excelsior, paper, ashes, tree branches, tree leaves, yard trimmings, furniture, -tin cans, glass, crockery, masonry and other similar materials. c. TRADE WASTE-AII solid or liquid material or rubbish resulting from construction, building operations, or the prosecution of any business, trade or industry, including but not limited to plastic products, cartons, paint, grease, oil and other petroleum products, chemicals, cinders and other forms of solid or liquid waste materials, provided, however, that trade waste shall not in- clude any coal refuse associated with the mining or preparation of coal. C. OPEN FIRE—A fire in which any material is burned in the open or in a receptacle not approved for burining. Section 2. ENFORCEMENT A. The chief of police, health officer, or. any other duly auth: orized agent shall - have the power and duty to enforce the provisions of this ordinance. Section 3. REGULATIONS After effective date no person shall: A. Ignite or feed an open fire for the destruction of refuse or in the conduct of a salvage operation in any public or private place outside of any building, or B. Cause, suffer, allow or permit the maintenance of any open fire for the desturuction of refuse or in the conduct of a salvage operation or any property under his control outside of any building. Section 4. EXCEPTIONS A. Open fires may be set in the performance of an official duty of any fire company officer if the fire is necessary for the prevention of a fire hazard which cannot be abated by other means, and for the protection of public health, if approved by council and a permit is obtained therefor. B. Open fires may be set with the approval of council provided a permit is obtained and pro- vided: a. No hazardous or other created by such burning. b. Burning of household wastes will be permitted in an approved container during day- light hours, an approved con- tainer being any container covered with one-half inch mesh screen. Section 5. PENALTIES Any person violating any of the provisions of this Ordinance shall upon summary conviction be sentenced to pay a fine of not more than $25.00, together with costs. Ralph Abele, Executive Director, Pa. Fish Commission, outlined the progress in im- proving the fisheries of the state at the Executive Council Meeting of the Pa. Association of Conservation Districts at Shomkin Dam, May 19. Abele said improving the waters for fish in Pennsylvania covers a period of 107 years from the establishment of the Fish Commission. Today the Commission has 417 salaried employees with a $6 million budget. The funds are derived from the sale of fishing licenses, Abele reported.
