ance in effect during the year 1963
which imposed a tax of 1% on sales
involving the transfer of real es-
tate located in the Township of Lake,
Luzerne County, Pennsylvania, has

of the Township of Lake without
substantial change, and the same
tax imposed for ‘the year 1964. In
accordance with the act of June 25,
1947, P. L. 1145, as amended, the

BISH, AND THE ACCUMULAT-
ION OF SAME, IN THE TOWN-.
SHIP OF LAKE, LUZERNE
COUNTY, PENNSYLVANIA,
AND IMPOSING FINES AND
PENALTIES FOR THE VIOLAT-
ION THEREOF.
BE IT ENACTED AND ORDAINED
by the Supervisors of the Township
of Lake, Luzerne (County, Pennsyl-
vania, and it is hereby enacted and
ordained by the authority of the
same. tat
SECTION 1. No public dump for
accumulation of garbage or rubbish
shall be permitted, established or
maintained on any land within the
Township of Lake except the Public
Dump now maintained and operated
by the Township Supervisors and no
person shall dispose of any garbage
or refuse in the Township of Lake
except by conveyance to said Town-
ship Dump where now located or to
such a place as may be designated
from time to time by the Board of
Supervisors as the official Township
Dump.
SECTION 2. Township herein
shall refer to the Township of Lake,
Luzerne County, Pennsylvania.
SECTION 3. The bringing into the
Township from anywhere outside
the Township any garbage or rub-
bish for the purpose of dumping, un-
loading, depositing, or disposing of
said garbage or rubbish in the
Township. is prohibited.
SECTION 4. The dumping, un-
loading, depositing, or disposing
anywhere in the Township of gar-
bage or rubbish brought into the
Township from anywhere outside
the Township is prohibited.
SECTION 5. The use of any pri-

or carrying on of a dump for the
receiving, unloading, dumping, de-
positing or disposal of garbage or
rubbish of persons, firms, or as-
sociations not residents in the Town-
ship is prohibited.
SECTION 6. The accumulation up-
on private property within the
Township of garbage or rubbish of
persons, firms, or associations not
residents in the Township is hereby
declared a nuisance. Such accum-
ulation is prohibited.
SECTION 7. The establishment,
maintaining or carrying on of a
dump or disposal or dumping point
or place anywhere in the Township
for the receiving, disposing, recept-
ion, dumping, unloadinng, collection
or accumulation of garbage or rub-
bish of any municipality andthe
residents thereof, other than the
Township is hereby prohibited.
SECTION 8. That from and after
the passage of this Ordinance it shall
be unlawful for any person or per-
sons to loiter about the premises of
said dump or to engage in the pick-
ing up or carrying away from said
dump any of the articles left at
said dump.
SECTION 9. Any person, firm, or
association violating any of the pro-
visions of this ordinance shall upon
conviction thereof in a summary
proceeding before any Justice of the
Peace be fined the sum of Ten
($10.00) Dollars for the first violat-
ion thereof, a n d Twenty-Five
($25.00) Dollars for any subsequent
violation thereof. And in default of
the payment of such fine, the vio-
lator shall be sentenced and com-
mitted to the County jail for a
period not exceeding thirty (30)
days. Said summary proceedings
shall be brought in the name of the
Township. Proceedings for the vio-
lation of this ordinance and for the
collection of fines imposed hereby
may be commenced by summons,
at discretion of the Justic of the
Peace before whom the proceeding
is begun. No warrant shall be issued,
except upon complaint on oath or
affirmation specifying the violation
théreof, All proceedings shall be
directed to, and be served by a
constable of the Township. ‘Costs
may be also imposed upon violators.
SECTION 10. If any section of
this ordinance, or any part of any
section, is determined by a compet-
ent court having jurisdiction to be
contrary to law, statute, or constit-
ution and therefore void and no ef-
fect, said determination shall in no
way affect what remains of this
ordinance; instead what remains of
this’ ordinance shall he considered
the act of the Supervisors as if the
portion or portions voided were
never a part of any ordinance. This
is expressly the intention of the
Supervisors, that any portion of
this ordinance not voided shall be
saved and shall have full force and
effect.
