parking of vehicles on public
streets’ during and following periods
of snowfall.”
.BE IT AND IT IS HEREBY EN-
ACTED AND ORDAINED BY THE
BOROUGH OF DALLAS AS FOL-
LOWS:
Section I: Tt shall hereafter be
unlawful to park'any motor vehi-
cle or to allow any motor vehicle
to remain parked wholly or par-
tially upon the paved portion of
any public street within the Bor-
ough of Dallas during or within
three days following any period of
snowfall in which snow in excess
of one inch in depth falls within
the Borough of Dallas; provided,
however, that parking may be re-
sumed within the aforesaid period
of three days, except where other-
wise prohibited by law, upon any
street where snow-plowing opera-
tions have been completed by the
Borough Street Department.
Section II: Any person who shall
park any motor vehicle in viola-
tion of the provisions of Section I
hereof, shall be subject to a fine
of Five Dollars ($5.00), plus costs,
and, in default of payment thereof,
shall be subject to imprisonment
in the Luzerne County Prison for
a period not in excess of five days.
Section III: Any person who
shall allow any motor vehicle to
remain parked in violation of the
provisions of Section I hereof, shall
be subject to a fine of Five Dol-
lars ($5.00), plus costs, and, in de-
fault of payment thereof, shall be
subject to imprisonment in the Lu-
zerne *County Prison for a period
not in excess of five days; pro-
vided, however, that in cases
where snowfall shall commence be-
tween the hours of 10 o'clock
P.M. and 9 o'clock A.M., no viola-
tion, of this ' Section shall be
deemed to occur if the parked
vehicle is removed prior to 9
o'clock A.M.
Section IV: If, at the time of
commencement of snow-plowing
operations on any street within the
Borough limits, any motor" vehicle
is found parked wholly or partially
upon the paved portion of said
street, in violation of the provi-
sions of Sections 1, II or III hereof,
such vehicle shall be towed from
the area and impounded at the di-
rection of the Street Commissioner
and shall be released to the owner
or operator thereof only after pay-
ment of the towing charges, plus
a fine of Five Dollars ($5.00) and
costs, plus an impounding charge
of Two Dollars ($2.00) for each
period of twenty-four hours or any
portion thereof during which said
motor vehicle is impounded.
