BE IT ENACTED AND ORDAINED by the Council of Dallas Borough, Luzerne County, Pennsylvania, and it is hereby enacted and ordained by authority of the same as follows: SECTION 1. This ordinance shall be: khown and may be cited as the Dallas Bor- ough Realty Transfer Tax Ordinance. SECTION 2. The following words when used in this ordinance shall have meanings | ascribed to them in this section, ex- cept in those instances where the context clearly indicates a diffeent meaning. “Association”. A partnership, limited partnership, or any other form of unincorporated enterprise, owned or conducted by two or more persons. “Corporation.” A corporation or joint- -stock association organized under the laws of this Common- wealth, the United States, or any other state, territory, or foreign country, or dependency, including, but not limited to, banking institu- tions. “Council.” The Council of said Dallas Borough. “Document.” ‘Any deed, instru- ment or writing whereby any lands, tenements or hereditaments within Dallas Borough or any interest there- in shall be granted, bargained, sold, or otherwise conveyed to the grantee, purchaser, or any other person, but does not include trans- fers by Wills or under the Interstate Act, mortgages, transfers between husband and wife, transfers between parent and child or the spouse of such child, and leases. “Person.” Every natural person, association, or corporation. When- ever used in any clause prescribing and imposing a fine or imprison- ment, or both, the term “person”, as applied to associations, shall mean | the partners or members thereof, and, as applied to corporations, the officers thereof. “Value.” In the case of any docu- ment granting, bargaining, selling, or otherwise conveying any land, tenement or hereditament, or in- terest therein, the amount of the actual consideration therefor, includ- ing liens or other encumbrances thereon and ‘ground rents, or a commensurate part of the liens or other encumbrances thereon and ground rents where such liens or other encumbrances and ground rents also encumber or are charged against other lands, tenements or hereditaments: Provided, that where such docu- ment shall set forth a small or nominal consideration, the ‘‘value” thereof shall be determined from the price set forth in or actual consideration for the contract of sale, or, in the case of a gift, from the actual monetary worth of the property granted, bargained, sold, or otherwise conveyed, which, in either event, shall not be less than the amount of the highest assessment of such lands, tenements or heredi- taments for local tax purposes. SECTION 3. Every transferor upon the trans- fer of real property or of any inter- est in real property, situate within | the Borough of Dallas, Luzerne County, Pennsylvania, regardless of where the instruments making the transfers are made, executed or delivered or where the actual settle- ments on such transfers take place shall be subject to pay for and in respect thereof, or for or in respect of the vellum parchment or paper upon which such document is written or printed, a Borough Tax at the rate of one (1) percentum of the value of the property repre- sented by such document, which Dallas Boro. Tranfer Tax (contin.) Borough Tax shall be payable at the time of making, execution, issuance or delivery of such document. SECTION 4. The Council may appoint the Re- corder of Deeds of Luzerne County or other persons as agents, for the collection af the tax herein imposed upon documents and may allow a commission to said agents of one (1) percentum of the tax collected. The Council shall pay the premium, or premiums, on any bond, or bonds, required by law to be procured by any agent for the performance of his duties under the Ordinance. All monies paid into the Borough Treasury under this Ordinance shall be credited to the General Fund. SECTION 6. . The Council is hereby charged with the enforcement of the provi- sions of this ordinance and is hereby authorized and empowered to pre- scribe, adopt, promulgate and en- force rules and regulations relating to: (a) The method and means of collecting the tax herein imposed. (b) Any other matter or thing pertaining to the administration and enforcement of the provisions of this ordinance. SECTION 7. No document upon which tax is imposed by this ordinance shall be made the basis of any action or other legal proceeding; mor shall proof thereof be offered or received in evi- dence in any court of this Common- wealth, or recorded in the office of any recorder of deeds of any County of this Commonwealth, unless a certificate as provided in this ordi- nance: has been affixed thereto. SECTION 8. Every document, when lodged with or presented to any recorder of deeds in this Commonwealth for recording, shall set forth therein and as a part of such document the true, full and complete value thereof, or shall be accompanied by an affi- davit executed by a responsible per- son connected with the transaction showing such connection and setting forth the true, full and complete value thereof or the reason, if any, why such document is not subject to tax under this ordinance. Any such recorder of deeds who shall record any document upon which tax is imposed by this ordi- nance without proper certificate affixed thereto as required by this ordinance as is indicated in such document or accompanying affidavit shall, upon summary conviction be- fore any magistrate, alderman or justice of the peace, or other officer having the powers of a committing magistrate, be sentenced to: pay a |. fine of fifty dollars ($50.00) and costs of prosecution, and in default of payment thereof, undergo im- prisonment for not more than thirty (30) ' days: Provided, That when any document shall have been recorded, it shall be presumed that all requirements of law affecting the title to any real property conveyed thereby have been complied with. SECTION 9. It shall be unlawful for any person to: 1. Make, execute, issue, deliver or accept, or cause to be made, exe- cuted, issued, delivered or accepted, any document, without the full amount of tax thereon being duly paid; or ‘2. Fail, neglect or refuse to comply with or violate the rules and regulations prescribed, adopted and promulgated by the Council under the provisions of this ordinance; or, 3. Fraudulently affix to any document upon which a tax is im- posed by this ordinance, any certifi- | cate not substantially the form pre- scribed by this ordinance. Any person violating any of the provisions of this subsection (a) shall upon conviction thereof, be subject to pay a fine of three hun- dred ($300.00) and costs of pro- secution. SECTION 10. The provisions of this ordinance are severable, and if any of its pro- visions or exceptions shall be held illegal, invalid, or unconstitutional, the decision of the Court shall not effect or impair any of the remain- ing provisions of this ordinance. It is hereby declared to be the legisla- tive intention that this ordinance would have been adopted if such illegal, invalid or unconstitutional provisions or exceptions had not been included herein. SECTION 11. This ordinance shall be effective for the fiscal year 1960. SECTION 12. This ordinance is enacted under authority of the Act of June 25, 1947, P.
