owners of all the surface and right
of soil only of that certain lot,
piece or parcel of land situate in
the Borough of Dupont, Luzerne
County, Pennsylvania, bounded and
described as follows:
“BEGINNING at a corner at
the intersection of Chestnut
Street and Hillside ave., thence
along Chestnut Street North
twenty-nine degrees (29 de-
grees) East, one hundred
twenty feet to a corner
in line of land dividing
certified lot No. 38, now or
late of the John T. Everhart
Estate, and certified lot No. 39,
now or late of the Hillside Coal
and Iron Company: THENCE
on and along said dividing line
South sixty-one degrees (61
degrees) East, three hundred
fifty-one and five tenth (315.5)
feet to a corner in the inter-
section of Walnut Street and
Hillside avenue; THENCE along
Walnut Street, South twenty-
nine degrees West (S 29 de-
‘grees W) one hundred twenty
(120) feet to a corner on Hill-
side Avenue: THENCE along
Hillside Avenue North sixty-
one degrees West (N 61 de-
grees W) three hundred fifty-
one and five tenths (315.5)
feet to the place of beginning,
and being also a part of certi-
fied Lot No. 38, now or late
of John T. Everhart Estate:
that said plaintiffs Joseph J. Cislo
‘and Romaine Cislo, acquired title
to said property from Thomas F.
Burke and Marita K. Burke, his
wife, by two deeds dated Septem-
ber 16, 1946 and July 25, 1947 and
recorded in Deed Books 906 -page
476 and 945 page 314 respectively;
that said Thomas F. Burke acquired
title thereto, interalia, by deed
from C. E. Banker and Mabel F.
Banker, his wife; that said C. E.
Banker acquired title thereto by
deed from the County Commission-
ers of Luzerne County by deed
dated February 27, 1945, recorded
in Deed Book 839 page 593; that
the said County Commissioners of
Luzerne County acquired title
thereto from the Treasurer of Lu-
zerne County by virtue of a sale
for non payment of taxes upon the
above land assessed against the
defendent, John T. Everhart; that
said John T. Everhart acquired
title to said lands by deeds of
Jonas Doty and Jennett Doty, his
wife, dated July 23, 1869, record-
ed in Luzerne County in Deed Book
143 page 240: Lot No. 38, Second
Division, Certified Pittston Town-
ship, of which the above described
land is a part, was patented to
one, Egra Sanford, by the Common-
wealth of Pennsylvania and there-
after, by divers conveyances, all
recorded in Luzerne County, title
thereto became vested in said Jonas
Doty; that the present whereabouts
of Elizabeth May Gill and Nina D.
E. Jones, their heirs, devisess, ex-
ecutors or administrators, is un-
known, and if they, or any of them
are dead, is also unknown.
WHEREUPON the Court ordered
and directed the Sheriff of Luzerne
County to make service of the said
complaint upon the said John T.
Everhart, and his heirs generally,
by publication, requiring them to
appear in said Court on the twelfth
