Whereas, A large number of per sons owning real property abutting upon that part of Main street, in the Borough of Ueynoldsvillo, which lies betweon the east end of tho bridge across Sandy Lick creek, on the West, and the east side of Seventh street, near the Presby terian church, on the East; hava pre sented to the Town Council a written proposition to tho effect that If tho borough of Uoynoldsvllle will cause said part of Main street to be .traded, curbed and paved with paving brick, during the present year, they, the said property ownors will pay one-third part of the coat of such grading, curbing and paving in front of their respective properties, the Borough of Reynolds vllle to pay the remaining one-third part of such cost. Now. THEREFORE, Be It ordained and enacted by the Town Council of the Borough of Reynoldsvllle, l'a., ana It is hereby ordained and enaated by authori ty of the same : - 1. That the above mentioned propo sition of proporty owners be and the same is hereby accepted. 2. That Dart of Main street whloh Is designated above shall, during the present year, be graded, curbed and pavea Wlla paving uriear, iu auuurunuue with the plans and specifications pre pared by James B. Caldwell, Eeq., which are hereby approved, are hereto attached and mado a part of this ordi nance. The above mentioned property owners shall pay that part of the cost of such grading, curbing ana paving which they have, In said proposition, agreed to pay and the remainder of such cost shall be borne by the Borough of Reynoldsvllle. 3. The President and Secretary of Council are hereby directed to adver tise in one or more newspapers pumisn ed in the Borough of Reynoldsvllle, and by hand bills, for bids or proposals for the grading, curbing and paving of said part of Main street in accordance with the provisions of this ordinance and the plans and specifications hereto attached. All bids to be for the completed work, including all materials, and to be uo eomDanled with samples of the brick proposed to be used by the bidder. The Counoil reserves the right to reject any nr nil bids. 4. The bids to be made shall be for the completed work by the square yard, measurements to be from the inside of both curbs. Said bids shall be sealed and be filed with the Secretary of Council not later than six o'clock p. m. on Monday, the 1st day of June, A. D., 1904. 6. The successful bidder will be re quired to enter into a contract in writ ing to perform the said work and furnish the materials therefore, In accordance with the provisions of this ordinunce and the plans and specifications boreto attached. The said contract shall pro vide for the commencement of the work on or before the 10th day of June, A. B., liKH, and the final completion there of on or before the 15tb day October. A. D., 11)04. The successful bidder will also be required to die with the Secre tary of Counoil, within forty-eight hours after the acceptance of his bid, a bond with sureties to be approved by the Council, In the sum of ten thousand dollars, conditioned (1) for the faithful performance of the work within the time above mentioned and In accord ance with the plans and specifications and (2) for the payment to the Borough of Reynoldsvllle of any and all sums wblcb may be recovered against it by reason or on account of any carelessness i or negligence on part of the said con tractor or any of his agents, servants or . employees, together with all fees, costs and expenses incurred by Bold Borough in aefonse of any una an suits or actions brought against It on account or. by reason of such carelessness or negllgonuo. 0.
