Innes, alleys and public rquarca of the Borough of Ki'.vnoklsviiie, to erect, maintain anil control poles and wlrea for the pnrposo of carrying and conducting eli-ctrloity, for tho period of fifty years, through Bald streets, lanes, alleys and public equaivs of the said borough of Iteyn oldsville as they now exist, or may bo hereafter changed, extended or estab lished, for tho purpose of supplying electricity to the citizen and Inhabi tants of the borough of Reynoldsvlllo, and for the lighting of the stores, offices, dwelling houses, streets, lanes, alleys, public squares and other places where electric lights may be needed and desired, and for the supplying of electricity for motor power, or for heat to such person or persons as may desire the same. Section 2. Said poles shall boereeted on tho streets, lanes, alleys and public squares at such plnces and on such linns as the Street Committee of the said borough shall direct, and the polos shall bo straight and of sufficient strength to carry all wires placed there on, and shall not he less than twenty five feet in height above the streets. Section 3. The said E. A. Ferrln, hi successors or assigns, shall within ninety days after this Ordinance goes into effect, commence to erect such lines and prosecute said work with reasonable diligence until said plant is completed. Scotion 4. This Ordinance "hall not go into effect until tho said E A. Fer rln, his successors or assigns shall file the stipulation accepting the samo with all Its provisions, and agreeing to be hound thereby. Said acceptance to bo filed within ton days or this ordinance to ho null and void. Section 5. That any ordinance or part of ordinance conflicting with this ordinance is hereby repeated so far as the same effects this ordinance. WHEREAS, the Borough of Reyn oldsville at a publio election held in tho said borough on the 16th day of September, 1SS8, submitted to the voters of the said borough the question of voting for public taxes for the furnishing of water and for the lighting of the streets, lanes and al leys of the said Borough of Reyn oldsvlllo, and for the furnishing of water, etc., and whereas, the said Borough of Reynoldsvlllo has not yet entered Into any contract for the furnishing of lights for the lighting of the streets, alleys, and publio squares of the said borough, Therefore, be it ordained by the town council of the Borough of Reyn oldsvlllo, and it is hereby ordained by authority of the same: Section 1. That the said borough hire from E. A Ferrln, bis heirs, Bucoessors or assigns, Arc Lights to be of not less than 2000 caudle power, to be kept burning during each and every night- during the period of this contract, to be located at such point or points as the Light Committee of the town council may direct, which said light during the continuance of this ordinance shall he kept and maintained by the Bald E. A. Ferrln, his successors or assigns, for the period of ten years from the date at which said light is turned on. In consideration for which the said Borough of Reynoldsville will pay to the said E. A. Ferrln, his hoirs or assigns, the sura of Sixty ($HU) dollars per uiinum for each and every Arc Light so kept and maintained. Said sum to bo puld quarterly on the Fli'Ht duys of Januury, April, July and October of each and every year auring tnu uioresuiu period ol ton years, froper cleuuctlonB ana allow, ances shall be made by the said K, A. Ferrln, his successors or assigns. for any light or lights that do not burn the required length of time. Said deductions aud allowances to be determined for each quarter, before the light bill is paid. The said E. A. Ferrln, his successors or assigns, shall erect said lights within six months from this date- and have the current ready to turn on within six months from this date. The said Borough of Reynoldsville will keep and maintain the aforesaid number of tights during the said term of ten years and for each additional light attached during the said term, the said borough shall not pay more than the sum herein stipulated to be paid tor Arc lights during the contin uance of this contract. Section 2. The Borough of Reyn oldsville will annually hereafter levy end collect from it inhabitants a tax for the purpose of paying for said Arc lights as now provided hy law. Section a. snould the said K. A. Ferrln, his successors or assigns, fail to accept this ordinance and no Sound by tho terms and conditions thereof within sixty (00) days from the dale, hereof, or fail to erect and operate said Arc lights within the time prescribed In this ordinance, then this ordinance shall become void, and the Borough of Reynoldsville shall be released from all liability thereunder. Section 4. That any ordinance or part of ordinance conflicting with this ordinance is hereby repealed, so far as the same enects mis ordinance. Section 2. That said sewer shall be built as follows: Diameter of sewer pipe to be decided upon by the council; to be placed not less than threo (3) feet below the surface of the present street, so that connections with the same can be properly made, from cellars six (tt) foot in depth reckoning from level of center of street. Tho SeworCommittee of the town council of the borough of Reynoldsville be and Is hereby author ized and empowered to proceed to buy materials, employ an engineer and la borers and make all nc-cessary contracts for the laying nut, construction and completion of said sewer. Section 3. That said sewor shall ho subjeot to all the rules, regulations and ordinances of the borough of Reynolds- vine now in force or that may be here after passed regulating such sewer, and sewer system of said borough, and no person snail be permitted to tap such sewer or oonnect therewith until such person or owner of property has paid bis or her proportion of tho costs of the construction of said sewer and complied with all the rules and regulations as aforesaid. Section 4. The costs and expenses of the same to be assessed and collected in accordance with the provisions of the Acts ol Assembly of the Commonwealth of Pennsylvania relating thereto and regulating the same.
