of thu streets, alleys, and public
square of the said horough.
Therefore, bo It ordained by the
town council of the Horough of Ueyn
oldsvllle, and It In hereby ordained
by authority of tho name:
Section 1. That the Bald borough
hire from K. A Ferrln, his heirs,
successors or assigns. Arc
Light to bo of not less than 2tXX)
candle power, to he kept burning
during each and every night during
tho period of this contract, to be.
located at such point or points as the
Light Committee of the town council
may direct, which said lights during
the continuance of this ordlnanco
aball he kept and maintained by the
aald K. A. Ferrin, his successors or
assigns, for tho period of ton yar
from tho da to ut which aald light is
turned on. In consideration for which
thn aald Borough of Reynoldsvllle
will pay to tho aald K. A. Kerrln. hla
helra or assigns the mm of Sixty (MO)
dollars per annum for each and every
Arc Light so kept and maintained.
Said sum to be paid quarterly on tho
First days of January, April, July and
October of each and ex'ery year
during tho aforesaid period of ten
years. Proper dod notions and allow
ances shall be madn by tho said E.
A. FeMn, bla successors or assigns,
for any light or lights that, do not
burn tho required length of time.
Said deductions and allowances to be
determined for each quarter, before
the light hill la paid. Tho aald E.
A. Ferrln, his successors or assigns,
shall erect said ligtita within six
months from this date and have
the current ready to turn on within
six montha from this date. The said
Borough of Reynoldsvllle will keep
and maintain the aforesaid number of
lights during thu mild term of ton
years and for each additional light
attached during the said te-m, thn
said borough shall not pay more than
thu aura herein stipulated to he paid
for Arc lights during tho contin
uance of thla contract.
Section 2. Tho Borough of Reyn
oldaville will annually hereafter levy
and collect from its inhabitants a
tax for the purpose of paying for said
Arc lights aa now provided by law.
Section 3. Should tho said E. A.
Ferrin, hla successors or assigns, fail
to accept this ordlnanco and bo hound
by tho term and conditions thereof
within Blxty (flO) days from tho date
hereof, or fail to erect and operate
said Arc light within the time
prescribed in this ordlnanco, then
thl ordlnanco shall become void, and
thn Borough of Reynoldsvllle shall be
released from all liability thereunder.
Section 4. That any ordinance or
part of ordlnanco conflicting with this
ordinance is hereby repealed, ho far
aa the aame effects this ordlnanco.

a majority in Interest and number
of property owner abutting on
the line of aald proposed Improvement
having presented a petition, therefore,
in Accordance with the Act of As
sembly regulating aewora, &c.
Seotion 2. That any ordinance or
. part of ordinance conflicting with thla
ordlnanoe I hereby repealed, so far aa
the same effects this ordlnanoe.

BE IT ORDAINED and enacted by
the town council of the horough of
Reynoldsvllle, in council assembled,
and it ia horoby ordained by authority
of the aame:
Seotion 1. That the right of way
is horoby granted to E. A. Ferrin,
hla heirs and assigns, duly organized
under the laws of Pennsylvania, to con
struct, maintain and operate for a term
of fifty (50) years a passage railway of
either single or double truck, with the
necessary turnouts and sidings by cable,
electricity, or horse power, along tbe
street named in seotion two (2) of this
ordlnanoe, and to construct, erect,
maintain, repair and operate and use
along said streets, such motors, cable,
electric appliuuce and convoniont
apparatus as may be provided for tbe
supply and application of the motor
power by cables, electricity or horse
power. Suid E. A. Ferrln, his heirs
or assigns, shull commence to erect
andoonstruut suid railway within one
year from the dute of this ordinance
and after commencing the ereotion
thereof, shall push it to completion as
rapidly as posHihlo.
Section 2. The streets ovur which
said right of way Is grunted uro as fol
lows: Main street, beginning at the
borough line on thu west and extending
through the borough to tlio burnugh
line on the east, and Fourth and Fifth
streets from Muln struct south to bor
ough line.
Seotion 3. Said E. A. Ferrln, his
heirs or assigns, In constructing suid
railway, shall conform to the grade of
the street as it now Is or may be here
after established and when luld, the
tops of the rail shall correspond with
the surface of the streets on the proper
grade, and no tracks of less gauge than
four (4) feet eight and one half (84)
inohes shall be laid. Such crossings as
may be required or directed by tbe
street committee or borough council at
street, alley and crossings fur a width of
twenty (20) feet shnll be huilt by said
E. A. Ferrln, hla successor or assigns,
that it posts, supporting Ita trolly
lines, shall be located with due regard
to the right of private owners of abut
ting property and such location shnll
be fixed by the said E. A. Ferrln, his
successor or assigns, in accordance
with tho regulation of tho atreet com
mittee of tho borough council. Tho
said E. A. Ferrln, his successor or as
signs, shall keep tho space of the
street within Its rail of the track of
said road and for a space of twelve (12)
Inches on either side thereof. In duo
and pro)cr repair at all times.
Section 4. Said E. A. Ferrln, his
successors or assigns, shall novercharge
or take more than five (,1) cents for car
rying each passenger at. one II mo from
tiie beginning to the terminua of lis
route, in the borough of Reynoldsvllle
or West Reynoldsvllle.
Section ft. Said E. A. Ferrin, hi
successors or assigns, shall operate said
passenger railway with due regard to
the street rights of the public on thn
atreet occupied by his road, and shall
equip, furnish and operate his road so
that a passenger nervlce will be main
tained between tho hour of o'clock
a. m. and 10 o'clock p. m., except in
case of temporary obstruction from un
avoidable a-cldnt, iiNin removal of
which tho subscribed service shall be
resumed as herein before provided.
Section A. This ordinance shall not
go Into effect until the said E. A.
Ferrln. his successors or assign shall
file the stipulation accepting the same
with all Its provisions, and agreeing
to bo hound thereby. Said acceptance
to be filed within ten days or thla ordi
nance to be null and void.
Section 7. That any ordinance or
part of ordinance conflicting with thla
ordinance Is hcrchy repealed, so fur as
the same effect this ordinance.
