Expert Account ant Meyer Goldsmith, the common wealth's witness, was under n scorch ing flro of cross examination nil day, and tho result thereof Justifies tho opinion that tho network of evidence wrought hy the prosecution from tho books of the broKen bank, tending to show Senator Quay's guilty participa tion In tho unlawful uso ot the bank' money, was very much shaken by tho admissions tho witness was compelled to make under the skillful questioning of Attorney A. S. L. Shlolds. Nearly all of the apparently damaging en tries attached to Senator Quay's name or account in the bank, as testified to on Monday, were explained awny or greatly modified by the statements of the commonwealth's own witness. Judge Dlddle's ruling of Monday had the effect of confining testimony tend ing to show the existence of a con spiracy between Quay, Haywood and Hopkins, as charged In the Indictment, to tho two years ending No. 17, 1898. Lawyer Shields got from the witness the admission that If Hopkins had properly credited Senator Quay's ac count with amounts that belonge.l there the books would show that at the beginning of the alleged conspir acy, Nov. 17, 189C, tho senator owed the bank only $23G, Instead of over $70,000, as Is alleged. Taking up the allegation that Sena tor Quay had borrowed $185,000 during the "settlement period" ending Oct. 31, 1897, tho last settlement before the bank closed, Mr. Shields forced from Goldsmith, piece by piece, facts tend ing to show that in nearly every in stance the amounts charged to Senator Quay were really loans to other per sons, politicians mostly, for whom Quay endorsed. Where there was a definite loan to Senator Quay tho re payment was clearly proven. In this connection it might be well to say that District Attorney Rothermol claims that ho has clearly established the fact he started out to prove, name ly, that $200,000 of the state deposit in the bank was set aside for the use of Senator Quay, and whether he used it himself or loaned It to others is not material In proving the conspiracy. Toward the close of the day's pro ceedings Mr. Shields asked Goldsmith some Questions which indicate that the defense Is about to attempt to provo Its contention that Senator Quay was the victim of Cashier Hopkins, who, they assert, used the name and ac count of the senator, without the lat ter's knowledge, to cover his own Juggling with tho bank's funds. Hop kins, they say, appears to have used fictitious names for loans, presumably to himself, as well as tho name of Sen ator Quay. Ho had the reputation of being a heavy speculator in the stock market, and the inference Is that tho defense will attempt to prove that Senator Quay had no knowledge what ever of the alleged loans on his ac count. Mr. Shields put a different complex Ion on the entries in tho "red book" by compelling the witness to admit that many of tho figures wero not proven by entries in the regular bank books, but were the result of what he practically acknowledged to bo his "guesses"- at tho meaning of certain unintelligible figures written in the "red book." Goldsmith was still on tho stand when court adjourned for the day. Much of the sting was taken out ot the famous "shake the plum tree" teler gram by the statement that the pur chase of Metropolitan Btock contem plated thereby was made with $10,000 of Senator Quay's own money, his da posit at that period exceeding $60,000.
