The taking of evidence In the case of Knyne Strahan Moore, accused of robbery In the first degree, wn resumed yesterday before llccotder Guff. Three witnesses gave testimony confirming that of Martin Mahon, the alleged victim of the badger game. Then Mrs. Fannie K. Johnson, who Uvea In West Fifty-seventh street, where It Is allowed Mahon took l''ayno Strahan Mnorc, Bald she knew Mahon and also the defendant, but did not i know William A. 10. Moore. She tes 1 tilled that she hail asked Payne Moore In the Tombs why she did not turn state's evidence, Mrs. Johnson broke ! down nt this point and shed many tears. In reply to a, question she said I Fayne Moore said she would not turn j state's evidence, because Mooie said he would kill her. The rest of her tes timony was given up to answering questions more or less relevant to the case, and then the waiter from the Met ropole, who served dinner to Mr. Mahon and the alleged Mrs. Moore, was put upon the stand. This ended the case for the prosecu tion and Mr. Levy, the attorney for the defendant, moved for a dismissal of the complaint on the ground that the prosecution failed to establish Its case. This motion was denied. Annie Fitzgerald, matron of the city prison, was called as the first witness for the defense. She denied having heard Mrs. Johnson advise Mrs. Moore to turn state's evidence, and also de nied other parts of Mrs. Johnson's evi dence. At this point the court ad journed. ,' Later In the evening the court was again called to order, and the opening was devoted to continued testimony of Mrs. Fitzgerald. After her came Hev. Ogden D. Homans, rector of St. Mat thew's Protestant Episcopal church In West Eighty-fourth street, who testi fied that on April 9, 1837, he performed a marriage ceremony between William A. K. Moore and Fayne Strahan. Ho said the defendant was the woman. Mooro was brought Into court and Dr. Homans Identified him as the man. Fayne Strahan Moore was then called to the stand and examined by Mr. Hill. She said that she was born on Feb, 23, 1877. Her father was Judge of the su freme court of Oregon when he died In July, 1887. She then removed to At danta, Oa and came to New York In the spring of 1896. She came here, she said, with the Intention of completing her musical studies. She went to Eu rope, returning In July, 189G. She said that she first met Mahon In August, 1S"90, on the occasion of a muslcale at the Amsterdam hotel. She said that Mahon had, uninvited, called upon her when she was living at firamercy Park. Mahon, she said, told her he was a married man, but was not living with Ills wife. He frequently took her car riage riding and to the theater. She then went to Atlanta, and on returning took a room at Mrs. Johnson s house. t Mahon's suggestion. She said the last time she had seen Mnhon previ ous to her marriage to Moore was in January. 1897. She told of her trips with Moore In this country and abroad. She then said that on the morning of Nov. 4 she re celved a telephone message from Mahon asking her to take supper nt the Mctropole. The rest of her testi mony recounted the supper In the rooms of the Orenoble, to which hotel they had gone later, and the scene In hlch Mnoie appeared and demanded the money from Mahon. She also spoke of the scene between Moore and De tectives Cuff and McNnught, but de led knowing that Mahon had given ny money to Moore. While In I'ortu Rico Mr. Porter hold public hearings, and all persons Interested In the welfare of the Island were Invited to submit statements and give oral testimony. The dlsugreuable smells of the typical Cuban city, his report says, are less pronounced In Santiago, while white wash, llmewash, fresh paint and all iiorts of disinfectants have deodorized the surrounding atmosphere and made' the old town quite habitable. The streets are no longer used as sewers, and the unhappy Individual who vio lates the law and eBcupes the lash of the sanitary commissioners' whip Is compelled to work on the streets for 30 days. This olllclal, Major Harbour, with 126 men dressed In spotless white and 32 United States mule teams and carts, having dug out from the streets of Santiago the filth of ages, Is now able to keep them absolutely clean. Every day, by the aid of petroleum, the garbage of the city is burned. The work of sanltntlon Is not con fined to the streets, but extends to the dwelling houses, shops and buildings of all kinds. To accomplish this, how ever, the doors of houses had to lie smashed In and people making sewers of the thoroughfares were publicly horsewhipped In the Btrects. Eminently respectable citizens were forcibly brought before tho commanding gen eral and sentenced to aid In cleaning the streets they were in the habit of defiling. The campaign has ended In a complete surrender to the sanitary authorities, and the inhabitants of San tiago, regardless of class, have had their first object lesson on the new order of things Inaugurated by the war. Several important streets have been repaved, and all the public buildings have been thoroughly cleaned, the work extending to the Opera House. The law courts, which were abolished when General Shatter took the city, have been reorganized. The supreme court the report continues, Is comnosed of carefully selected Cuban Judges, the appointees nominated wholly on ac count of lecal attainments, the Bar association of the province having been consulted as to the character and qual ifications of the new Judges. In the same manner local government has been restored and native mayors and officials appointed, the only require ment being that persons accepting such ofllccs s.hnll take the oath recognizing the military occupation of the Island by the United States, but In no way committing them to any future form of government. The Spanlih, when In possession of Cuba, not only assumed absolute con trol of the Judiciary, but of the munici pal government, the larger portion of the taxes raised for municipal pur poses being diverted, with the other revenues. In channels which, says the report, either went to Spain or in Span ish pockets. Mr. Porter advises that these taxes hereafter must be used ex clusively for local purposes, and as far as may be deemed practicable that they be collected and disbursed by properly constituted local authorities. The rural districts of Santlngo have been so depleted that It would be Im possible to collect taxes over and above those needed for the bare necessities of schools for the poor, and possibly small sums to Improve sanitary con ditions. Tho dnwn of prosperity, how ever, should be the signal for Inaugu rating systematic work on the country roads. Mr. Porter recommends that nn Im mediate scheme be prepared for levy ing and collecting Internal revenue for the entire iHlniul. The question of sepa rating these (axes from purely munici pal tnxes snouid also lie considered. The large amount of delinquencies dur ing the least three years, which amounted to about $6,000,000, was of course due to the war. In normal times we have here $4,000,000 or $3,000,000 of revenue that must not be overlooked, revenue which, If properly and econom ically employed, would aid In the In dustrial rehabllatlon of Cuba.
