Washington, July 21. The re port that General Calixto Garcia has been shot and killed is without foundation. But the report that he has withdrawn from the Ameri can lines is continued. Toral will bo court- martiallcd fur surrendering Santiago to the Americans, hut it is not probablo that he will he punished. It is beliuvcd horu that the lettor allegod to havo been written on July 15 by Gen. Toral to Gen. Shafter was a forgery. Tho reason for this belief is that tho letter says tho government had author ized flen. Toral to capitulate Tho govern ment did not uutliorizu tho surrender, but Instructed Captain-General lllatico to leave the initiative to Gen. Toral. The military code prescribes Imprisonment for life for any officer who surrenders the forces of fortified posts which, though de pendent upon his command, aro not Included in the action causing the capitulation. Rubens, Counsel to the Junta, Thinks It Likely That Garcia Was Sent by Shafter to Intercept Spanish Rein forcements and Cut OS the Retreat of Spanish Soldiery, and There Met His Death. New York, July 21. A Kingston, Ja mnlca, cable to the Rvenlng Post says: "Cubans arriving from Slboney bilnR In reports of the death of General Gar cia. They make a mystery of It, say ing that It should not be known In Cuba yet, or in the United States, for reasons of state, and give no particulars ex cept that he was shot. Spanish refu gees here who are otllclally connected with General Illanco believe the story." The last wold directly received by the Cuban juirta In this city from Garcia was dated before Santiago, July 11. It was a cable message, and stated brlelly that he was well, and that the progress of events was satisfactory. At that time Gnicla was to the west of Santiago, guarding the approaches from expected reinforcements to the city. Horatio S. Itubcns, counsel for the Junta, when given the Information con tained In the above dispatch, said that news of Garcla'a death had not been received at the junta, but that at best communication with the Cuban forces In the Held was Irregular. "I am great ly surprised," he said, "but I do not And It hard to credit the dispatch. "During the assault on Santiago Gar cia was In the west with his command, with tho special duty of Intercepting OIWISRAI. GARCIA, reinforcements and cutting off the re treat of the Spanish soldiery. When tho city fell his duty there was at an end. Hut It appears the attack on Man zanillo was then planned, and It Is probable that Shafter detailed Garcla's command to cut off reinforcements there. Ilolguln lies near this city, and was garrisoned by a considerable force, as the American general must have known. It Is not unlikely that Garcia and his men came Into conflict with a body of Spanish soldiery bound from Ilolguln, ond that there Garcia met his death." Calixto Garcia was In his COth year and was regarded by the Cuban In surgents ns one of their most Intrepid soldiers. In the ten years war his skill, bravery and energies won him con tinued promotion until he received a general's star. In an action In 1871 Garcia waH surroumVd by Spanish troops. Ttather than surrender he shot himself through tho chin with suicidal Intent. lie recovered, and was sent to Spain. lie was released In 1S77, when the peace of Zeujim was declared. Garcia at once set out for New York and organized nn expedition to Cuba. He landed In Santiago de Cuba, but was taken a prisoner a second time. He eluded the vigilance of the prison guards In Spain one night after a 15 year's Imprisonment, nnd Med to ICng land. Garcia was the promoter of tho Haw kins expedition, which left this city In January, 1890, with 300 men and a large quantity of supplies and ammunUlon. The vessel sunk. He next fitted out ..he Bermuda, which was seized upon the eve of her departure, In February, 1886, by a United States marshal and his deputies. Garcia was arrested und re leased In $2, G00 ball. He at once made another start and Innded In Cuba sev eral days before the day set for his trial In this city. For the last two years he had been engaged In conducting the campaign of tho Cubans against Spain In tlio province of Santiago de Cuba. Tins pait added a rather humuious color to the affair. Hunasawlcz selected an hour when tho second story of the hotiso was deserted and mado arrangements for tlio suicide in ono of tbo bedrooms. He tied one end of the rope around his neck and then stood 011 a trunk and tied the other end of the ropo to a rafter of tho roof. When he satified himself that everything was loady ho jumped from tlio trunk, hut instead of swaying in tho air Ills body fell in a heap on tho floor. The ropo had parted. Tlio man was evidently determined to die and ho again got upon the trunk and tied together the ends of the parted rone aud then made another spring for eternity. The would-be suicide received a double surprise. as tlio rope not only parted a second timo.btit liunasawicz shot liko a rocket through tho Hour and ceiling to the first floor. Thero bo met with a warm reception. The boarding mistress was at llrst shocked by the noiso and falling plaster and wood, accompanied by the would-be suicide's body with the Pieco or rope dnngliug from his neck.
