The dining- room or the Kimball hotel was the scene last night of a sensational encounter be tween Judge John Uerry, of the city court of Atlanta, and Orth Stein, a well known newspaper man nnd at present editor of The Looking Glass, a weekly publication. The dining room was well filled, and the affair created the greatest excitement. Many ladles and gentlemen, on seeing the blood besmeared face of one of the com batants and a pistol Hashing in the hands of tho other, became panic Btricken. Doth Judge Berry and Mr. Stein board at the Kimball, and were at dinner at the same hour. According to Stein, Judge Berry walked up to him, and without a word struck him across the forehead with a bottle of catsup, cutting an ugly gash and knocking Stein out of his chair to the Moor. Berry then, Stein says, kicked htm several times In the face, making bad wounds. Stein drew his revolver, but in getting It out of his pocket he loosened the breech. Berry then seized the revolver and pummelcd Stein with It until he was nearly unconscious and his face covered with blood, The waiters and some of the guests, who had by this time mustered up courage enough to approach tho two men, separated them and removed them from the dining room. Judge Berry's side of the affair dif fers somewhat from the statement made by Stein. The Judge says he walked up to Stein and spoke to him, saying: "How do you do?" Stein did not reply, and Berry then struck him. The revolver. Judge Berry says, was drawn Intact from Stein's pocket, and In order to prevent him from using it he (Berry) unbreeched It. Berry was arrested. The direct cause of the attack was an article in the last Issue of Stein's paper, but the real trouble dates back some months, and has a bearing on the support given Mr. Stein's paper. The Uni ted States dispatch boat Fern arrived here yesterday afternoon from Matan zaB. Tho Fern's trip was uneventful. Hho reached Matanzas on Saturday, and at onue began discharging provis ions Into lighter-. On shore a few per sons had gathered, but there was no demonstration of any kind. The share of provisions for Matanzas was got Hd of In u business like- way, and the Fern then sailed for Sagua La Grande, where the same program was gone through on Sunday, the operation of landing the stores occupying about six hours. United States Consul Uarker board ed the Fern upon her arrival at Sagua. He was overjoyed to see on American ship once more, even thougli it was only the little Fern. The consul said there were about liR.OOO starving recon centrados in his district. An officer of the Fern said to the correspondent to day: "It seemed as if the gladness of the wretched Cubans at our arrival was stifled by the overpowering dread that hangs above the peoplo-. of Cuba, and that could not be dispelled even with the coming of food, for which they longed. Naturally we saw little. Ours was no exploring trip. But we saw enough to convince us that the stories emanating from Matanzas, and especi ally from Sagua La Grande, are not exaggerated." The Fern will probably go back with more provisions about Friday. The torpedoes and shells which ar rived Saturday were transferred yes terday at Fort Taylor, and consider able local excitement was raised over rumors that they were being placed In position. An officer who would be connected with such work, however, denied this report, and said: "When you see these mines or tor pedoes being placed you can make up your mind that war is more imminent than It is at present. They will not be put In position until the last moment, for, however good the mine, It is al ways liable to become useless through the action of the water. "We are not going to risk the usefulness of expen sive explosives by premature submer sion. All these torpedoes can be laid In 21 hours. If we laid them now they would not only bo liable to corrosion, but everybody on the Island would get an Idea of their positions. "The delicate nature of these de fense torpedoes seems hardly to have been realized by theorists as to the Maine explosion. It Is incomprehen sible to me that tho Spanish govern ment, in times of peace, allowed high power torpedoes to lie at,the mercy of the water In Havana harbor. It would be against the Judgment of all experts and the practice of all governments, for nowadays these weapons can be laid at the shortest possible notice. Al though I do not think Havana harbor was mined, I know there are torpedoes In Morro Castle, and a naval arsenal that can be put in position very quick ly." The return of the court of inquiry is wearily awaited, especially by the ofllcers of the Maine, who will have been here a month tomorrow. They have been expecting to go to their homes on every boat of late, and now the hope deferred, added to the fact that they are still without adequate wardrobes, makes them thoroughly discontented. Their orders, which are here awaiting the court's pleasure, provide that they shall return to their homes and await orders, which prob ably means a month's leave. Washington, March 15. Consul Gen- rral Lee has notified the state depart ment of the death yesterday at Sagua La Grande, Cuba, of the wife of Sena tor Thurston, of Nebraska, on board the yacht Anita. Senator and Mrs. Thurston were members ot a congressional party which left Fort Monroe March 2 for a trip to Cuba on the yacht Anita. The party had a stormy night off Hatteras, and put into Charleston. Tho trip was continued after a few days' rest. The Anita first touched Cuba at Havana, and afterward went on to Matanzas and Sagua La Orande. The brief an nouncement or Mrs. Thurston's death w'as quite unsatisfactory to her many acquaintances in this city, and every effort was made to secure details, as the demise was most unexpected. Mrs. Thurston was In excellent health when she left the rity, having taken nn ac tive part lu the annual convention of the Daughters of the American Jii volu tion, which met here tho week before her departure.
