Dlt tenhofer; Lauterbach and Llmburger, counsel for Dr. Cornelius Ilerz, yester day appeared before Solicitor Penfleld, Rt the state department, and presented a claim for Indemnity in the sum ot tB.000,000 ngnlnst the French govern ment for an alleged Illegal attempt to persecute Dr. Ilerz. The case Is re markable In many ways, and it said nt the department Is without a precedent. The facts In brief are that Dr. Herz, whose name stands very high in scien tific circles as an electrician and phys icist, although born In Prance, of French pa rents, is an Amerlcnn citi zen. When he was about 3 vpnr. nf ntra "T'Ss his parents came to New York and acquired Ameri can citizenship. Young Ilerz was educated In. the New York Free Academy, now the College of COHNELIUS IlKHZ. iorK, ana received two degrees. He rounded this out by courses In Heidel berg and other European universities. At the age of 1G years he was a lieuten ant In the United States army. In 1871 he was charged by the municipal au thorities of Chlpago with a mission in connection with the reconstruction of the city after the fire. He afterwards held posts of responsibility and honor in San Francisco and New York. Meanwhile his fame as an electrician had spread, and he did much to extend the study of this branch of science, be sides establishing, as his brief claims, the forerunner of one of the largest of the great electrical corporations now in existence In this country. He married an American woman, and when his children were born In Paris he caused them to be registered as American cit izens at the consulate. On Jan. 19, 1893, his troubles began. He was stopping at Bournemouth, England, with his wife. In bad health, when he was arrested under extradi tion proceedings on a warrant from the French government, charging him with fraud and embezzlement growing out of the Panama scandal. Under the law a prisoner wanted for extradition must appear at the How street police court. Herz was confined to his bed, and so unable to appear. The case was kept open, and he was continued under arrest In his bed four years, during 1893 to 189G. Then the British parliament came to the relief and passed a special act that permitted the magistrate to attend Herz's bedside and take his tes timony. This was done, and the mag istrate promptly declared that the charges wereutterly Invalid and scarce ly deserving of notice. This was May 2, 1S9G, and Herz was released from arrest. Meanwhile the French government had Instituted proceedings against him in France and confiscated all of the property of himself and of his wife. Dr. Herz alleges that this was persecu tion pure und simple, and that the French government knew that tho charges against him were baseless be fore his trial. Therefore, claiming to have been Injured In name and health and In other ways, he demands that the state department shall prefer a claim against the French government In full reparation. Although he names no special sum, the brief shows that he demanded the sum of $5,000,000 in a letter he sent to the president of the French republic, but which was never answered. In accordance with ills previous notice, Senator Da Vis, chairman of the senate committee on foreign relations, brought up the subject of the ratification of the Ha waiian annexation treaty In tho sen ate yesterday. His motion wns made soon after the disposal of the routine morning business, nnd the entire re mainder of the day's session, except the time given to the confirmation of nominations, was devoted to the con sideration of the question as to whether tho treaty should bo considered In open session or behind closed doors In execu tive session. After a debate of almost two hours upon this point an Informal vote was taken, and the decision was overwhelmingly against un open ses sion. Tho motion for open sessions wns made by Senator Gray, of Delaware, who presented his leasons in a speerh of about five minutes' length, urging that the question was one of public concern, involving no entangling com plications with other nations, and one which It was therefore eminently proper should be considered before the public gaze. Senator Davis replied to Mr. Gray, contending for the observance of pre cedent In this matter and objecting quite Btrenuously to the proposition that the senate should take the public into Its confidence In considering tho treaty. He took issue with Mr. Gray on the proposition that there were nn general questions Involved affecting our diplomatic relations with other countries, and predicted that the dis cussion would take a wide range befoie, its conclusion. . Speeches In favor of the Gray resolu tion were mnde by Senators Caffery, White, Mason and Morrill, and In op position by Senators Morgan, Hoar, Spooner and others. Senator Morgan was the principal opponent of the aray proposition. He talked at length upon the Importance of observing the sen ate rules in discussing this question. He said that no one would think of asking ihe president and the cablnpt to take up tho treaty In the presence of the general public, and he contended that for this reason the obligation of secrecy was greater upon the senate than It would be upon the executive branch of the government. Most of the senators who spoke In opposition to open sessions referred to the probability that the action of the Euroi 1 powers In their evil purpose of partitioning the territory of China would form the basis of much of the debate on the question of Hawaiian annexation. All who referred to this phase of tho question manifested u disposition to regard It as a delicate and complicated one. Senator White was among those who replied to these statements. He spoke spiritedly and In a sarcastic vein of the folly of attempting to keep executive secrets within the control of the sen ate. Ho made reply to the suggestion that the control of the publicity In re gard to treaties should be left to the executive, saying that the treaty It self had been made public, as had also the president's message upon tho sub ject. Senator Morrill contended tb.it the question of annexation wns one of much public interest, and said that on this account the public should I" fully Informed of the reasons for and against annexation. He spoke verj brlelly. Senator Mason took advantage of the opportunity to make a speech directed generally against executive sessions lie announced his Intention to support the motion for an open session, and said that he would take advantage ni all such openings to exercise his in lluence to break "down the senatorial rule for secret sessions. He asserted that tho rule was out of date, out ot keeping with the progressive tendency of the times, moss grown and obsolete, and argued that It should be abolished. If, as many people believed, the senate was out of sympathy with the public, the requirement of the discussion of so many importnnt questions in executive session was, more titan nny other reason, responsible for this condition of affairs. The annexationists now claim 59 votes for the treaty, lacking only ont of the number to ratify it. On the other hand, the opposition say the ratl flers will fall shoit from three to five votes. The opponents of the civil service law had much the bot of the debate In the house yesteiday so fur as tho number of those engaged In it were concerned. Nine of the 11 speakers were of tho op position. The friends of the law nro very anxious to shut off further debate, and In this will have the co-operation of Sneaker Ileed and the rules com mittee. Mr. Moody, who has charge of the bill, gave notice that he would test the sense of the house toduy on a mo tion to close debate.
