Uugnrt's rroseoutors Celebrated Ills Con viction by ii Ilnnqnet. FlTTsntma, Fa., Jan. 12. A petition for a new trial for Professor C. D. Bogart, of Shenandoah, who was convicted last week In tho Criminal Court of a charge of assault on Clara Vates, of Knoivlllo, was presented yes terday afternoon. New trial was asked on tho grounds that tho court orrod la Its charge to the Jury. Judge White was averso to hav ing tho petition filed, and remarked that there wero no justifiable grounds for grant ing a new trial. It would simply mean a repetition of the testimony, lie suggested referring the matter to tho District Attorney before bringing into court and that will be .done. Bogarf s prosecutors have been severely criticised on account of a banquet held by them in honor of his conviction. More Deception. Ed. Herald : It appears the opponents of Sir. Bogart wont allow the case to rest, even after a jury trial, and like Banquo's ghost will not down. Your suggestion to allow tho matter to rest, togother with your apparent deslro to eschew sensational news, Is heartily coumonded by citlzeus of all classes. I overheard a conversation between a repre sentative of the Nows, by tho name of Fowler, I believe, and a newspaper man from Mahanoy City, which convinces me that our people are being deceived in this Bogart affair, From this conversation it is learned that tho News proposes to publish the verbatum report of the trial, and to cover up its tracks and to avoid tho just charge of sensationalism it will publish a communication, in its issue this ovcnlue, January 12, and sign It "Protestant," where in Uio.Hehald will be criticised nnd its own paper commended in the ono and tho same breath. They will also make the claim, as a bluff, that a number of Protestants demand the publication of this testimony. The two papers have also entered Into a compact to attack your paper, and at tho samo time to dofend one another from the charge of sen sationalism. So you can see tho docp laid scheme. I send you this for publication so the public can sco in advance the object to bo gained by theso two responsible (?) news papers, in their "you tickle me and I'll ticklo you" scheme. Just watch further develop ments and see if I am uot right. , Justice. Shenandoah, Jan. IB, 1897. Wo publish (he above communication for what it is worth, with thanks to our corres pondent. PflClFIG RfllltHOAD PASUljE RILLED The Dili Overwhelmingly the House. Defeated in GOVERNMENT'S PROBABLE ACTION Assistant Attorney General Russell Says Congress Can Legally Declare a For feiture of the Land Grant and Property of the Paolflo Roads, VAaHIKOTON, Jan. 18. The Paolflo mil road funding bill went down to its (loom In the house yesterday under an adverse majority of 66. The friends of the meas ure who had predicted Its passage up to the last moment were surprised by the decisive character of tholr defeat. They had been led to hope from the votes on the suletltutes that ihe bill h,nl moro than nn even chance of passing. The Hell substi tute provided that If the Union l'aclllo and Central I'acldo would clear off the first mortgnge and advance the govern ment's Hen the governmont would extend tho Indebtedness at 8 per cent It wns de feated by a vote of 110 to 5S. The Harrison eulistltute provided for a commission to negotiate a settlement of the dobt. This wns rejected by the house by a vote of 66 to 214. Many of tho members were as muoh op posed to those substitutes as to the Pow ers bill. The California and middle west members volod almost solidly against them. When the vote oame dn the main proposition the whole opposition swung into lino nnd orushed It by nn ndvorso vote of 102 to 168. Tho vote was uot tnken di rectly on the passage of the bill, but on the preliminary motion to engross 'and rend tho bill a third Umo. Dills, tho subject of hard oontosts, nre usually brought to n final teat before the last parliamentary stage is reached. The Rollly I'aolllo funding bill, two years ago, was defeated In the same manner on the samo motion. This Is the fourth funding bill killed In the house In ten years. An nnnlysla of the vote shows that 85 Republi cans and 10 Demooriits voted tor tho bill nnd 99 Republicans, 58 Democrats, a Popu lists mid 6 Independents against It Mr. Powers,' the ohalrmnn of tho Pa cific railroad committee, entered n motion to recommit the bill after ho had re covered from the shook of his dofont, pay ing that tho mombors of the house were all In favor of n settlement, but evidently opposed to tho principle of tho measure his conmiltteo had brought in. Ho thought his committee should have an opportunity to formulate another bill, in tho hopothat It would prove acceptable. A point of or der was mado against Mr. Powers' mo tion, but, ut tho BUgposllon of tho speaker, tho point was not ruled upon, tho ruling bolng postponod until today. Mr. Powers said last night that he did not know what would be dono, but ox pressed tho opinion that nnohpr effort should lie made to pasiTnn acceptable bill. Tho oppononrs of the bill, on tho other hand, are rejuiolng, aud say yesterday's voto settles tho fnto of all schomos to fund tho dobt nt this session. Aftor the bill was disposed of the army appropriation bill and several other blls wero passed. Tho army bill carried $83,128,344, f 153,558 less than that for the curront year. What action tho govornmont will tako elnco tho Pacific railroad funding bill has boon defeated In congress cannot bo stated. It Is believed that it Is the Intention to take somo step looking to the settlement In the courts, If necessary, of this long ponding und voxod question. According to tho treasury figures on Jan. 1 the net amount due to the United Stntes by tho bond nlded roads, after deducting tho amounts credltod on acoount of transpor tation service, is 1131,810,876, the original principal of which was $04,038,512. In ad dition to the amount owing to tho United States tho companies, undor tho authority granted by the act of 18S4, Issued bonds amounting to fd 1,018,000, which havo since, by act of oangross, become a first lien on the roads. It is tho oplniou of many that before tho governmont oould institute foreclosure proceedings It would bo compelled to socuro tho Interests of tho first Hen holders. This, howevor, Is not tho opinion of Assistant Attorney General Russell, who holds to the opinion that congress can legally doolaro a forfeiture of tho land grants and proporty of tho roads on tho ground of conditions broken. Tho chief ovont of yestorduy's senate session wns an Impassioned speech by Mr. Mills, ot Texas, In favor of a resolution introduced by him to declare the recogni tion ot a foreign govornmont a congres sional prerogative and to reooguize the in dependence of Cuba and appropriate $10, 000 for tho salary of a minister. The Sen ator quoted a long line of preoedents and strongly denounced the administration, charging it with favoritism toward Spain. He spoke contemptuously of Cnstellarand Weylor and of Slgnor Crlpsl because of his declaration that Europe oould not look without ooncera upon the pretensions of tne united states. The Cuban Question was tho mercantile spirit of tho nation against Its honor, ho declared. Mr. Proc tor made a speech In favor of a constitu tional amendment to limit the president to one six year term, aud Mr. Allen, of Nebraska, made an unsuccessful attempt to secure the adoption of a resolution call ing on the secretary of the navy for In- lormauon as to whether contractors' men In the Brooklyn navy yards are made to wore more than eight hours per day.
