Centre streets received some lime ago through
tho nppenrancc of cracks in tho surface, sup
posed to liavo been caused by tho settling of
workings in the Klmwood colliery, appears
to havo been not entirely without reason and
tho I'. & It. company has taken precautions
to prevent any further damflgo from this
source. This morning MliilngSuperlntehdent
John Veith and Master Carpenter Christ.
Muchlhof weie in town nnd gavo orders lor
tho slushing of all tho under ground
workings of tho Klmwood colliery in
the vicinity of the affected houses.
A srraper lino will bo built from tho Maha
nuy City colliery dirt bank to the linibor
way in tho swamp lichind ICaier's brewery.
From this point tho culm will bo convoyed to
tho underground workings of the mines by
chutes. Tho work will commence at once.
A pump baa been placed at an nrtesiau well
on the luouutlan. Water is (lowing from a
depth of 15 feet nnd it will bo used to feed
tho boilers furnishing stenni for tlio second
well, which Is to bo sunk about 700 feet. Both
well will supply tho l'rimroso colliery with
water.

Wlinlen, Eqii represented Flynn. Tho fol
lowing witnesses were examined : Michael
licfTron, James McIIugh, Michael l'ribula,
Michael Scanlan, Justico J. J, Cardiii, 1'cter
Quirk, William II. Shoemaker, John Bcgloy,
James Smith, John V. Ctirtln nnd W. J.
Watklus. Tho two last named witnesses
werccalled to testify to proceedings before
the Hoard of Health nnd llorough Council in
connection with tho nuisance that existed
before tho erection of the. stono wall nnd
subhtriiciit' proceedings. Tlio trend of Mr.
Whalen's lino of examination was to show
that tho stream In question is a public sewer,
that at times tho borough 1ms performed
certain acts in connection with It to inako
tho stream a public sower, that the borough
has given ponnlts for tho connection of
sewerage lines with tho stream. Mr.
Whalen's line of examination also tended to
show that tho stream has been changed from
its original course.

sanco and ho did not think Flynn com
plained to tho Borough' Council at that tlmo.
Smith als'd stated that the covering of that
part of the stream tlowiug through John
Bobbins Whlto street property fell In and
created a nuisance As Mr. Robblus and his
family were at Oceah Grove, Smith took
upon himself the work of abating the nui-
sauce and Mr. Bobbins subsequently paid the
bill.
.Mr. Whalun stated that Mr. Watklns, til
town clerk, had been called to establish by
tho minutes of Council that permits had been
granted to connect sower linos with tho
stream, but upon examination Mr. Watkins
testified that ho could find no sucii permit In
tho mlnutcs'aud during his servico as Town
Clork he did not know of the granting of
such a permit.
John W. Ciirtln, secretary of tho Board of
Health, testified that the stream flowing
through Mr. Flynn's property had
been declared a nuisance by the lizard
of Health' and the Borough Council had
been asked to abate it, but failed to act. He
admitted that If tho stream was properly
covorcd and sealed the 'nuisance would bo
abated, when cross-examined by Mr. Pomoroy,
and also adffctted that after the Stone wall
was erected f'le Borough Council had invltod
the Board of Health to co-opcrato with it in
suppressing tho nuisance caused by tho wall.
He also admitted that at a meeting of tho
Board of Health held immediately after, no
action was takon further than a discussion of
tho matter and an adjournment for a few days
to hold a joint meeting with the Borough
Council to deviso meaus for an adjustment of
the matter, but the meeting was not held,
the Council failing to appear, but he admitted
that Solicitor Pomeroy appeared aud read
the resolutions the Council had adopted and
the Board took no action,

borough, Shenandoah, propose to demand
rocognitfou, politically, Is not In accord
ance with American ideas. Undoubtedly
this class of people have the right to demand
recognition and shuts of public offlco and
patronage, but the method of demanding it,
not because they are citizens, hut because
they are of a certain class or nationality,
should causa their overtures to be promptly
rejected by both parties.
