Ciirtln, secretary of tho Board of Health, testified that the stream flowing through Mr. Flynn's property had been declared a nuisance by the lizard of Health' and the Borough Council had been asked to abate it, but failed to act. He admitted that If tho stream was properly covorcd and sealed the 'nuisance would bo abated, when cross-examined by Mr. Pomoroy, and also adffctted that after the Stone wall was erected f'le Borough Council had invltod the Board of Health to co-opcrato with it in suppressing tho nuisance caused by tho wall.
