At the beginning of the pres ent year the statu was Hooded with clrcu lars issued by tho smaller trust compnniei in Philadelphia, sotting forth that us tin act of 1801 taxed the capital stock of cor porations at 5 mills while other property was only taxed 4, the extra mill was un constitutional, and stating that it had been aRked to ncl ns the custodian of 9 fund for the purpose ot having the mattei determined by the courts. Nearly every corporation of tho State received such n cir cular and was asked to join in the move ment. Somo of the circulars also fell into the bands of Statu officials here. A number of companies accepted the in vltation of the trust company and nppeals were accordingly entered, the companies paying four mills tax and appealing from tin- odd mill. The companies against v hieh judgments were entered were the liull'alo, Rochester and Pittsburg Railroad ( ompany, Johusonbiirg and Ilradford Kail- ond Company, Bristol Water Company, iiiitl Mill Cieek Railroad Company, which were Rigued a short time ago by Mr. New lin, of Philadelphia. Judge Simonton makes very short work of the constitutional objections, holding that, under the princi ples laid down in numerous decisions of his court and of the supreme court, classifica tion may be carried to a much grentei Jengt h than necessary for the purpose ol Mistnining the tax in question in this case. 1 he taxation of tho capital stock of these corporations at a different rate from the taxation of the personal property of indi viduals does not result In a want of uni fortuity forbidden by the constitution. While it is true that the capital stock of corporations represent their property it is not identical with it and cannot in any real sense bo said to belong to tho same class of subjects as the personal property of individuals. He holds also that the act of 1891 does not couflict with any of the provisions of tho constitution of tho united btntcs. Judgments ure therefore- directed to 1)0 entered against tho four companies above named for the b.ilanco of taxes claimed by the state, with interest at 12 per cent, per annum and attorney general's commission of 5 per cent.
