Mr. Lamb knows that If the reports in that book were made as full as those In the Herald tho room and stationery committee would kave needed an extra appropriation to keep the secretary supplied with books. We will admit that the Hebald has not reported the proceed ings of Council in the order in which tho business was transacted and that is one reason why the official minute book will not conform to the Herald's reports. For instance at one neetlng of Council several months ago the eight combined members of Coun cil waited until after the bills were read and the seven minority mem ben had left the room before passing a motion grantingthe joint oommitteo n water works several hundred dol lars for expenses. When the official minute book was presented at the aext meeting that motion occupied a position in the body of the minutes and before the report on bills. The Bra axd made a true report of the matter and that report stands uncon tradicted to this day. Mr. Lamb will rely upon the Council record because as he reoently said in his public com Monlcation, he had an opportunity "to correot and reject" any part that salght be repulsive to him. However, ouncll has taken its course and we take ours. When the proper time comes Mr. Lamb and his cohorts will find that we will be most willing to sILscubs with them what should and what should not form a part of the public records. In the Columbia College School of Mine there has been established within the very walls of the building for the pait tiro week a gam bling den. Roulette was tho popular game, and an many a three and some times four wheels were run nt the name time. Tho place mi located In the corner of the basement of the School of Mines, and the wheels were run in a little nook protected from general view by the rear partition wall of tho janitor's ofQce. Tho students who ran the wheels had a little the best of the odds, and many students have lost money who could not afford to. The gambling might have gone along unnoticed for some time to come had it not beeu for a row over a gauio. The news of tho row reached the fac ulty, and the true cause was learned. Supt. "It U for the Jury," he said, "to de termine whether poison was put Into the coffee or tea, or the food in the mill. "This question depends solely upon the testimony of QalUgher and Davidson. If they tell the truth, then the defendant was the orignator and principal in th business and is responsible for the acts of Gallagher and Davidson or either, and accountable for whatever they did in pur suance of his Instructions. "Now, just here comes the great ques tion so far a the defendant is concerned. "Dempsey emphatically denies what Gallagher and Davi.lson have to say In re gard to the purpose for which ho em ployed them. He Is a competent but an interestod witness. They are also compe tent, but suspicious and tainted witnesses, "But the jury may, if they beliov their testimony, convict from it alone." The jury after being out until 1:10 p. in. came iu for further Instructions from the court. Foreman Guy wanted to know if the court had stricken out of the in dictment the third nnd fourth counts and ha was told that the court could not do this, but hud instructed tho jury to no quit on the counts which related to Dom soy assaulting persons unknown, for thero was no competent ovidence ottered on thete counts.
