At tho clost of tho afternoon session of tbe Lingc murder trial in the Camden county court house it was rumored that the defensa would have some sensational evideuco to present to shatter the theory of the proso cution. It was stated that ox-Judgo Wescott, chief counsel for Lingo, had two wit nesses who would go on tho stand and testify that they saw Mrs. Miller como out of the much-famed "Bush lot," in which, the State claims, Liu jo tuurdurad her. The importance of this testimony lies in the fact that, according to the State's claim of evidence, Mrs. Miller never came out of the "Bush lot" on the afternoon of tbe fatal day. It is also a part of the defense's effort to take the guilt away from tbe colored mini and place it upon the head of John Miller, the husband. Ex-Judge Wescott was asked subse quently whether this rumor was true. "Yes.lt is true," he answered reflectively, and with apparent reluctance. "When will the evidence be given!" "In due time. I do not see bow this matter ever came to be divulged. We desired that it should not be known." When asked who tbe witnesses would be the ex-Judge replied: "They are two colored men whose desire Is to tell t lie truth. They will testify that they saw Mrs, Miller emerge from tho Bush lot ou the supposed afternoon of the murder." It is known to Prosecutor Jenkins and bis colleagues that tbe defense will pro duce this evideuco to prove that Mrs. Miller was murdered at her homo. The prosecution will oiler evidence to show that these two witnesses have served terms in prbon and that their word cannot bu trusted. Tho notorious Tolbert feud has broken out in Kemper county, and, as a result, three men are lying dead in coffias at Fort Stevens, a small town 25 mi'es north of Meridian. John Tolbert, the youngest of tho boys, has a Winchester bullet through his teart, while his father, Tom Tolbert, has bis neck brokon and his body filled with uickshot. Thomas Cole, a member of tho sheriff's posse, has a bullet in bis brain, the result of the unerring aim of one of tho Tolberts. Tho story of this family of dospera does would fill a volume. Five years atto tho family consisted of six, old man Tolbert and his sons, John, Toirl, Jim, Bob and Bill. Led by their father, the cang has been a terror to the law abiding peoplejOf tbe county. About four years ago Jim, Bob and Bill, were killed in a battle with a sheriffs nose. The remainder ot the gang escap ed Into the dense swamps of Oktibbjabe river, where they remained in billing until three years ago, when they became more bold and renewed their course ot outlaway. Saturday night the sheriff and bis posse attacked Tolbert's bouse, being armed with Winchesters. The battle raged fiercely for two hours whon the ammunition of old man Tolbert became exhausted and he was forced to surrender. Tho posse then started on its way back to Fort Stevens but was met by a mob. comnosed of 1.000 farmers who overpowered tlie guard aud strung tlie old man up to a tree. Young Tom escaped from his father's house and took refuso at tho farm ot a relative about five miles distant. When his whereabouts became known a mob of 1,1500 men left for the scene for tho Ditrnoss of lynching Tolbert and ull of his relations. Nothing has been heard from the mob since thfy left Fort Stevens, but news of a battle is expected as tbe mob will no doubt meet with a desperate resistance. Fort Stevens is twenty-live miles from a railroad station and the only means of communication with Meridian is by courier. The1 last messenger left tbe scene at o'clock yesterday afternoon.
