Tho appeal to the civil courts would bring up only tho question whether Colon ol Streator honestly exercised his dis cretion in tho performance of his duty as a soldier. If he did he cannot be made answerable to tho civil authority. A military court of inquiry could condemn and dismiss him; could reprimand him for abuse of authority or could approye his action; and it would be woll for the mili tary service and well for the somewhat confused public opinion, to have a military inquiry into tho caie. Above all, lot it not be forgotten that the troops at Homestead aro in actual war service and that, with anarchy and assassi nation threatening peace, propetty and life, tho stern laws of war must bo para mount to all ordinary theories of senti ment or humanity.
