There Is no objection to allowing the people of this borough to vote on the queatiou na to whether or not public water works shall he osttiblUhed, but there Is a strong objection to steps in that direction before the joint com mittee renders an accounting. That committee drew a largo stun of money out of the borouuh treasury on the strength of the special election held Bevvrat years ago and the court has decided that the committee had no right to act under that election. Now then, let that committee- account to tho Borough Council and the people. The people have a right to know how much was expended, wliHt tho iloiu'V was spent for and what hope, if any, oxIMh for its return. At the mots meeting in Bobbins.' hall Councilman Lamb repeatedly contradicted Councilman Holmait when that gentleman stated that he voted to have tho electric road paved If Mr. .Lamb will refer to the Borough Council minutes he will find that Morris Wurm, Councilman at that time, made the motion providing that the electric railway should bo paved Willi mountain stone and that the motion waB carried by u unauimoiitt -vote. WB WERE RIGHT. People who have been doubting whether the Herald was justified In rapping the members of Council on the knuckles for their conduct In con nection with the electric railway ought to bo convinced by this time that the Herald was right. The statements of the Councilmen and tho official minutoi of the meeting ens tain the Herald's position. Tho Herald charged that the eight Coun cilmen, of whom so much has been said, stopped the construction of the electric railway in town. The Coun cilmen stated to their friends, on tho streets and at the muss meeting in Bobbins' opera house, that they did not stop tho work. Theeo statements were contradicted at the Council meet ing ThurMlay by the reading of the ollicial minutes and statements of the Borough Solicitor. The attempts to ahleld themselves by oral statements to Judge Sadler made by certain mem bers of Council is nonsensical. Tho motion recorded Is this: "On motion of Gable, that the Solicitor and Street Committee act In conjunction and secure an injunction against the elec tric railway company." Theto is nothing in the motion authorizing Mr. Betterldge, or any other Council man, to glvo the railway company ten or fifteen days time, or even an hour. The railway was obliged to stop work or become a party to a law suit and as the latter uiticle is an expensive lux ury (our Councilmen will admit this) Judge Sadler stopped the construction of the road. The Council raised the guu and took aim. Before they could pull the trigger the railwoy company got out of range. The Borough Council has decided to apply fur a new trial In the case of ex-High Constable Fuirley ngalnst the borough. The application will In all probability be deuled, as It Is really only a matter of form requisite for an appeal to the Supreme Court, and by the time the borough gels through the experiment the original claim of about 35 will have developed into a healthy lump of three figures, or more. It la true that the case establishes a bad precedent, but our borough cannot af ford to'go to the Supreme Court ou test If Hues, A jury has decided that Mr. Falrley la entitled to hla cMra. If the jury erred It ia our misfortune, but tho borough cannot be benefitted by decision of the Supreme Court, whatever it may be. One thing la certain, the borough will never get back what It has or may spend on the case, and It strikes us that the cheap est and common sonso plan would be for Council to pay the claim and costs and swallow tho dose like little men. This suit ia a consequonce of tho celebrated Bochum income tux caso which involved an accusation of fraud and collusion against Director Baaro o( tho Bochum Steel Institute in Bochum and the Income Tax Assessors. Fusangel edited a newspaper in Bo chum, and was arrested for libeling the Assessors and Baaro. In June last he was sentenced to prison for five month. At about that time Prlnco Bismarck said in a public speech that the persons then attacking tho Bochum steel industry probably were in the pay ot foreign gov ernments. This was supposed to be a reference to Fusangel and is the basis of his com plaint against Prince Bismarck. Awrul Deed or a Jealous IfusbnntL Stracusm, N. Y., April 23.
