A Decisios. harded doh by Justice | Giegerich, of the Supreme Court, obliges General Manager Smith, of the New York Central Railroad, to stand trial for manslaughter for the fatali- ties that resulted from the smash-up on the Harlem division, some months ago, on the newly electrified line of the system. The New York Central has moved heaven and earth to prevent Mr. Smith being made the example; but with all its power and influence, with all the Vanderbilt money, and even the intense persuasion of Chaun- cey M. Depew, late president of the line, the law says that somebody has to be responsible for those people who were killed. This is a very important test case; and all the railroads of the country regard it apprehensively; for if Smith be convicted, he will- have to goto prison; and high officials are naturally alarmed over such a possi- bility, as it will establish a precedent that will make accidents hereafter mean something beside paying out a few dollars to square the victims of their heirs. But public sentiment be- came highly wrought over this Har- lem accident, and there was a demand of “an eye for an eye.” Terror reigns in the offices of the New York Central; but Smith will have to, face a jury, just the same. BERKEY AND THE BANKS. Pittsburg Gazette Times, Sept.9. The action of the Pennsylvania Bank- ers Association, last week, empowering the newly-elected president to appoint a committee on legislation, with in- structions to prepare a bill for a com- plete revision of state banking laws, goes far toward neutralizing the criti- cisms passed upon Banking Commis- sioner J. A. Berkey’s administration of his department. It indicates that the trouble is more with the law than with the official entrusted with its enforce- ment. These criticisms, by the way, were far from being unanimous. They were confined largely to the national banking interests, who are wholly ex- empt from the supervision of the state banking department. The managers of some state banks and trust com- panies have not hesitated to assert that jealousy of and interference with state banking affairs on the part of the na- tional banks were responsible for the enactment of the reserve law, in con- struing which Mr. Berkey has been Be this as it may, it must be admitted that his position on the reserve law is perfectly logical, and follows the precedent of the comptroller of the currency in en- forcing the law relating to national banks. A national bank could ‘not ob- tain the approval of the comptroller if it should select a state bank or trust company as legal reserve agent, for the good and suflicient reason that such agent would be outside the juris- diction of the federal department and its bank examiners. Mr. Berkey’s po- sition is unassailable if he applies the same logic to his department. It is true that the Pennsylvania law gives the commissioner a broad discretion in the premises, but inasmuch as formal approval of a reserve agent carries with it a certain degree of moral re- sponsibility, it should not appear strange that discrimination be made between an agent wholly outside the jurisdiction of that department. It has been cited against Commis- sioner Berkey as proof of incapacity that he has in some instances approved a national bank in New York for one Pennsylvania institution and withheld approval of the same bank for another institution. To the ignorant, such ac- tion might seem inexplicable, and yet a critic, especially a banker critic, who finds this ruling “absurd” and “ridicu- lous,” condemns himself. The obvious intent of such discrimination is to pre- vent a congestion of reserve funds be- longing to the banks of one town or city in a few banks in New York, which are not only outside the department, { but outside the state. We would not assert that one man or set of men, could exercise this diserimination with entirely satisfactory results, but we think it should be clear to any un- prejudiced mind that tho object sought —the minimizing of the effects of a an out-of-the-state reserve agent—is entirely praiseworthy No reflection is intended in these re- marks upon the strength and solvency of any national bank in the state.
