The Went Branch Lumberman's Exchange filed a bill in Equity in the Court of Northumberland county agi.inst John liyers, Gary A. Barret, (Jeo. 1. Fisher, John Fry, Oeo. Hoover, Abel Ilerroldaud about 170 more persons to force thom to give op tho logs lodged there and permit them to enter upon their land and remove said logs without in any way remunerating the owuers of said Is lands for the great damages done to Uiir properties by said logs. Charles Howcr was employed by ihe parties named to resist tho Lum berman's Exchange in their outra geous attempts. Tho caso came up Lt-foro Hon. Win. M. Rockefeller at Sunbury and he decided in favor of Mr. Hower's clients and made an order that the V. 1$. L. Exchango saut p.iy Mr. Hower's clients 50 rents per thousand feet, board meas ure, before they dare enter ou their Islands to remove said logs when thus forced the Exchange did pay John Uyers about $1000., George P. Fisher nbout glOO., Gary A. Barrett about !?JiK)., John Fry about $100., George Hoover about 1100., and Abel Herrold about ifiOO. Total After the Exchange paid that mon ey then they were permitted to ro uovo tho logs. As to the other 170 men they were not required to pay them anything and they took the l)gs from their land without paying them for tho iujury done. Tho Exchange found that they could not drive Mr. Hower's clients with an iron rod but that they must respect their rights. In tho May flood of 1891 a largo lot of li:;s again escaped from t ho .Soi'ins. Some of them lodged on the land of Charles Howcr and did liim damage. Tho Exchange again made its ap jiearnnco and issued a writ of replev in ug.iihst. Mr. Hower and his tenant to force them to give up the logs without paying them the damages the logs did. Mr. Hower resisted the attempt on their part to impose i'U Uiiuaud brought suit against the paVta.- Jpreenting the West Lrunch Lumberman's Exchange for the damages.
