About 9:30 o'clock last night fire broke out in the confectionery store conducted by Mrs, Joseph Watson at No. 104 Lake street, and before the firemen could extinguish the flames damage to the extent of $500 was done to the bullding and contents. Mr. and Mrs. Watson occupy living rooms on the second floor of the building and it was in a room on the second floor in the rear that the flames originated. The members of No. § hose company at West Sayre were holding a meet ing In thelr rooms only a short dis tance from the burning bullding and as soon as they discovered the blaze they hurried to the scene. They suc- ceeded lu getting a stream of water on the fire and in the meantime a general alarm was sounded and the department turned out, and the flames were extinguished. The origin of the fire is not known, but Is presumed to have started Trom a chimney. The loss is covered by Insurance, Maroney Sent to Owego. John Maroney, wlio is charged with having robbed the cash register at the Sayre house of $9.40, while the bartender was absent from the room has been sent to the Tioga county jail at Owego to await requisition. The sald Sayre Electric Company, Its successors or ' assigns, shall at all times hereafter save and keep harmless the Borough of South Waverly from any and all suits, ac- tions, damages, costs, counsel fees and expenses of every nature and kind by reason of the rights and privileges hereby granted. Section 6. The sald borough shall have during the term of this franchise, without charge therefor, the right to use the poles of the sald Sayre Elec- tric Company, its successors or as- signs, for police and fire alarm wires, withont hindrance or molestation, using for the sald purpose the upper- most portion of the poles. Section 7. Should the sald Com- pany, its successors or assigns, at any time decide to place its wires, cables or appliances or any other part thereof underground it shall have the right to construct the neces- sary underground subway or conduits in, under, on or across the streets, alleys, lanes, avenues and public places within the sald borough for sald purpose. Sald work to be done under the direction and supervision of the Borough Council apd the streets, lanes, alleys, avenues and public grounds of said Borough shall be placed In as good condition after the work has been done as they were before, and in case the sald Com- pany, its sucessors or assigns, fall to clean up the sald streets, avenues, lanes, alleya or public grounds or make necessary repalrs, In that case the Borough shall have the right to do said work, and collect the cost thereof, with all costs, expenses and counsel fees, from the sald Company, Its successors or assigns. Section 8. This Franchise shall terminate at the expiration of thirty- five years from the date of its grant- ing Section 9. The sald Company, or some one duly aothorized in Its bes half, shall within thirty days from this date file a written acceptance of this franchise with the clerk of the Borough Council and shall pay the expense of drafting and advertising this Ordinance Section 10. A fallure on the part of the sald Company, its sucessors or assigns, to fully comply with all the terms and conditions of this fran- chise shall render the same, and all rights thereunder, vold and the same shall thereby be forfeited.
