An indication that Sayre is prosper- Ing may be found in the statement of the First National bank of Sayre which ajpeurs elsewhere in this Issue. The business of the bank shows a Iarge Increase since the publication of the last statement—a fact that Is Best grade Lehigh Valley and Ber- livery, bard and soft wood. Both phoues at yard and office at Raymond ed to Sign Temperance Pledge Is Not Ofliclally Ver'si d&. Yesterday's Hazleton papers and at least one local daily contained sior- les to the effect that orders will be issued Ly the Lehigh Valley daring the next few days requesting each and every emplove In the Jperating department of the company to fill out A blank form, which stipulates ex- pressly that they have taken a pledge to refraiu Dom Indulgence in the cup that iotoxicates It will be remembered by readers of this paper that the Record several weeks ago contained a story in which It was intimated that the Lehigh ofli- clais were contemplating a move of this character, so it will readily be seen that the stories in yesterday's papers were just a little belated In fact the rumor had whiskers on it white with age, and it is understood from high authority that the Lehigh Valley officiais do not propose to go Valley officials do net propose to go in- to the pledge business. They have, how- ever called ‘he engineers in the upera tng department up on the carpet and admonished them against the evils of the drink demon. They have also asked the men to refraip from going into saloons and thereby avoid the very appearance of evil, but at that time the rumor that the men were to be e£sked to sign a pledge was stot ly denied. While the officials believe in doing all in their power to pro- mote sobriety among them. both for the welfare of the laiter and the trav- eling public in general, they hesitate to so far Interfere with the personal rights of the men as to ask them to sign a pledge. What would signing a pledge amount to anyhow? Now and then you will find a man who will look upon his solemn pledge as a sacred act, and he would no more think of violating it thas he would of viciating his solemn oath. But in the great majority of cases a pledge is signed only to be broken Signing a pledge hao never gone very far tow- ard making a man sober. If he real ly wants to be a sober citizen he can do so without resorting to a pledge On the other hand if he wants whis key, he will resort to any means to obtain it, pledge or no pledge The majority of the throttle men on the Lehigh, however, are sober industrious citizens, and it is not nec- essary for them to append their names to a pledge to keep them sober “Good Citizenship Rally.” A “Good Citizenship Rally” will be held in Pharmacy hall, West Sayre, on Thursday evening next. The rally will be addressed by Eugene W. Chat- in, L. L. B., of Chicago, who Is rogard- ed as one of the best orators on the platform today. On Thursday afternoon shortly af- O'clock Mrs. William Larabee lost her life along with her home at Hollenback ter 2 The particulars as fearu- ed are as follows Mr. Larabee and her Willlam Getz were away from home, the lat ter being down at Bahr's store, at the time of the discovery of the fire bs Mrs. Larabee who had left the house ifter a pall of water ed that on looking back from the spring she saw that the house was on fire. She al once remembered that son, aud it 11 2 ppos about $12 was in a room on the secund door of the house and she returned in an atiempt to re- cover that sum. Apparently she was only able to get back in the house when the roof fell in, as ber remains were found Just inside of the door aftcr the fire had burned out. Several men at Bahr's store, about a half-mile distant from the house discovered the blaze soon after it had started but on thelr arriva: ar the fire could do nothing as the entire struc ture was in flames, although had they known that Mrs. Larabee was lying suffocated by the smoke just inside the door her life might have heeu sny ed as the flames had not at that Ume broken out there. Later the remains were recovered and placed in a t bacro pail, and Jus tice of the Peace J. M. Sweet, acting 48 coroner, summoned a jury as fol- lows: Willlamm Dall, C. R. Ihe preliminary steps In a manda- mus proceedings were Laken yesterday by Willlam P. Wilton of Towanda, act- Ing us altorney for H. A. Kaufman, a former Sayre clothing merchant, #ho weal into bankruptcy here about 4 year ago,-when a clesk from Mr Wilson's office served upon Justice W. T. Carey a court rule returnable on Monday morning next before Judge Fanning. The rule is au alternative writ of mandamus and is an order from the judge to appear and show cause why a premplory writ of man- damus should not Issue directing the justice to deliver to the defendant a transcript on appeal in the case of Paul E Maynard versus H. A. Kauf- man, in which a judgment for $50 and costs of suit was renderd in fay- or of the plainuff and against the lefendant on January 24th. The mandamus proceedings are the outgrowth of the refusal of Justice Carey to deliver his transcript on ap- peal until the defendant first pays the record costs as well as the costa of appeal. On Tuesday forenoon Attor- ney Wilson came to Sayre and went befure Justice Carey and demanded a transcript on appeal. He tendered the justice $1.25, the actual costs of taking the appeal, but the Justice re fused to entertain de H¥er a transcript unless the costs of sult, which are known iu legal par record costs, were also pald Wilson refused to pay the record! the appeal or ance Mr costs and the justice refused the tran script. Mr. Wilson left the office with the understanding that he would commence mandamus proceedings and thercby make a test case, stating that he would like to get a decision in the case so he would know how to advise clients in this respect ip the future, here appears to be no common rule as to whether a justice has a right to demand all ‘costs on an ap peal, and heretofore It has been large- ly a matter of local practice. Ther= are a number of county court decis ions sustalning the position taken by Justice Carey and there {8 also some which would appear to be against it The concensus of opinion among the able members of the bar In this sec tion of Bradford is to the effect that a justice has an Indisputed right un der the law to demand his costs on appeal, and that he (s perfectly justi fled In refusing to deliver hls trans- cript until the appellant has complied with this condition. Justice Johnson of Athens, who Is one of the oldest and without doubt the best justice In the county, has always demanded and received the costs on appeal, and Iu this position he has been suslained by décic'ons. of both the superior and It has also Leen con- sidered good practice among the -19s- tices of the state generally, and there are decistons galore iu favor of {tL During the year which Jusuce Car- ey has been In office there have been a half dozen or more cases taken to the higher courts on appeal. but with one exception the payment of the en- tire costs has never been questioned [he exception was In tae case of Car- ling versus Kaufman, In which the former obtained judgment for dental services Kaufman made affidavit that Injustice had been done and de manded ap appeal. He quibbled then about paying costs, but his brother Da<ld Kaufman, who was represent ing him at that time, finally decided to pay all the costs and the appeal wis granted The legal firm cf Maynard & Schrier other well known legal! talent will appear in the interests of Justice Carey when the matter comes before Judge Fanning on Monday next as county courts assisted by New Lehigh Spur.
