Injuries From Which He Died.
A distressing accident occurred
Tuesday afternoon when G Clande
Coon, a son of the Hon Giles M
Coon, a former member of the legis-
lature from this county, was pinned
beneath a failing log and sustained
injuries from which he died a few
hours later The young man was
about 30 years old and was engaged
in drawing logs. One of the logs
slipped from the load and fed upoa
bim, fracturing a Humber of ribs The
ragged end of one of the broken rils
punctured the lungs His face was
also badly lacerated. He was taken
to his home and medical ald was sum-
moned. It was of no avall, however,
and he died a few hours later. He
was the oldest son of Glles M. Coons
and had scores of friends He

Two of Them Declared That They
Were Ill, But the Judge Refuses to
Discharge Them on This Ground.
About ten o'clock this morning the
fury in the Messenger murder case
came into court at Towanda and re-
poried that they were stifl unable
to agree. Two of the jurors also re-
ported io the judge that they were
ill and they asked to be relieved from
further cousideration of the case
The judge refused to permit the jury
(o be discharged and sent them back
to find a verdict one way or
another
Had the jury been discharged on
account of the sickness of two of the
mambers it would have resulted in
another venire being issued and Shar-
rone would thus be compelled 10 uu- |
dergo another trial, but should the]
Jury report a disagreement. under!
the ruling of the Suprme court that |
when a jury is once sworn in a cap- |
tial case the defendant is then placed
in jeopardy If the jury disagrees
and the defendant was placed on trial
again he would then have been placed
in jeopardy twice for the same of-
fense, and this would clearly be a vio- |
lation of his constitutional rights

charged on account of the iliness of

INJUNCTION CASE HEARD
TUESDAY AT OWEGO.
Waverly—Judge Lyon of Hingham-
ton, sat at Owego Tuesday and heard
the evidence, and listened to the ar
guments of the attorneys in the in-
Junction case between the village of
Waverly, and the various companies
concerned Senator Hinman of Bing-
hamton and F. A. Bell of Waverly, ap
peared for the village. Mr Thomas
Reenan was present to look after the
interests of the W. 8. & A. company
The Elmira, Corning and Waverly
company was represented by Fred
Collins, while F. E Hawkes appeared
for the Powers Mansfield Co
Considerable evidence was {ntroduc-
ed The judge instructed the attor-
neys for several parties to the suit
