Roberts vs. Asa T. Pritchard, both of Sayre, was heard in Towanda yesterday before six jurors, summoned by Sherifil Job Griffin, and the case involves an interesting proceeding in law. Roberts obtained a judg- ment before a justice at Sayre and an execution was issued against the personal property of Pritchard. as “nulla bona,” or no goods, which means there were no goods attachable under the execution, A writ of fi fa was issued and a levy made thereunder on the real estate by Sheriff Griffin. Pursuant to the act of assembly the sheriff held an inquisition yesterday by summoning six jurors who were sworn to ascertain whether rents and profits from the land above al reprises would satisfy the judg- ment within seven years, The jury found in the negative and accords ingly “condemned” the property as required by the act. The shenff will now make his return and the plaintiff will in all probability pro- ceed to rell the real estate. The six jurors summoned by Shenfi"Griffin were J. T. Corbin of Athens, S. E. Sweet of Sheshequin and J. W. Keating, Otto Mayor, G C. Hollon and A. C. Blackwell of Towanda. NO POSTPONEMENT OF JOASON TRIAL Charley Johnson will certainly face a jury at the approaching term of court at Towanda A motion was made before the court yester- day by W. P. Wilson of Lilley & Wilson, his attorneys, for 4 con tinvance of the case to the next term of court. District Attorney Mills objected to the continuance on the grounds that the jurors had already been empanelled, the wit- nesses summoned, and all prepara tions on the part of the common- wealth completed for a trial of the accused man. He argued also that it would result in large ex pense to the county if the case was postponed longer. Accordingly Judge Fanning ordered that the casc be brought to trial without delay. AS A BROTHER AT AUCH CRUNK This morning Chief of Police James Walsh received a telegram from the chief of police at White Haven stating that the parents of Patrick Burke who died in the Packer hospital on Thursday night, were dead, but that the deceased has a brother residing in Mauch Chunk. The local authorities will endeavor today to get into com- munication with the Mauch Chunk man and it is quite likely that he will come here and take charge of remains. YESTERDAY'S CAME The ball game yesterday after noon between Binghamton and Kaae resulted in a victory for the latter team, score 2 to 6. The game was an exciting one from start to finish but was witnessed by an exceedingly small crowd. The two aggregations were to have played again this afternoon but on account of the attendance the Binghamton players decided to cancel. From information received over the pris vate wire of the Waverly stock exchange this noon it is learned that the miners have stolen a march oa the operators, and the chances are that in a few days they will be back to work as usual. In addition to the news contained on the first page of today’s Record a later dispatch states that the sub committee, to whom the entire strike matter’was referred, has de- cided to submit a proposition to the miners’ convention today rec- ommending the resumption of work under the terms of the 1903 agreement. It is coasidered pracs tically certain that the recommen- dation will be adopted by the con- vention this afternoon, and that the miners and operators will get to gether on that basis at a joint con- ference to be held on Tuesday.
