Waverly,—The Village Board of Trustees met at Town Hall Sat urday evening. The hall was crowded with people. The presi dent announced that the committee had called upon the Water com pany, but owing to lack of instruc tions had been unable to make an offer. The committee given power to employ Wednesday Wis experts to arnve at the value of the water plant and to submit the same to the Water company. The president asked Village Attorney Hawkes if he could aid them in case of litigation Mr. Hawkes stated that anticipat ing this question he had prepared a communication to the Board This stated that as a stockholder and attorney for the Water com pany he could not conduct htiga tion against the Water company, but if possible he would be pleased to act as attorney in other matters, or he would tender his resignation Mr. Tucker him how it would be 1n regard to the Waverly, Sayre & Athens Traction company, and Mr. Hawkes stated that at a recent meeting he had gmiven the Board advice which had been dis puted by Mr. McDowell, for the Chemung Valley Traction company and that Mr. Bell had been appealed to and had sided with Mr. McDowell. The attor ney said his ruling was correct and cited a similar case to prove his assertions. He said that when he could not act in the dual role of attorney for the trolley company and the village he we ol bring the matter to their attention. On mo tion he was asked to resign, which he did. Village Clerk F. A. Bell was clected in his place. A vote of thanks was cxtended Mr Hawkes for the able manner in which he had assisted the Board in their deliberations S. C.
