The indictment laid the offense with tho word
" feloniously," as required by one section 'of the
statute under which the offense was prosecuted.'
It is doubtful whether the case comes within the
act of 1867; and to sustain the indictment, under,
the other section of the code, the word " feloni
ously" must be considered surplusage, and 'mere
matter of form, which must have been taken ad
vantage of before the jury was 'sworn. Another'
. indictment was premehted, and the motion in an,
rig, of judgment was not made ; so the question
remains undecided. At common law, a convic
tion for a ruldemetinor could not be- had on an
indictment f 7 a felony. Sentenced to two years
and four months' imprisonment

Same vs. Michael Ryon. Larceny. This was
a charge for stealing sheep. The. testimony of
two witnesses on the part of the Commonwealth'
was so " inundated" with the had opinions - of
their neighbors as to their " truth and voracity,"
and the good character of the defendant 'was-so
well sustained, that the jury brought in a verdict
